AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR EXCAVATION AND THE REMOVAL OF
DIRT IN A R-1, RESIDENTIAL DISTRICT, LOCATED APPROXIMATELY IN THE 900 BLOCK OF
WALNUT STREET AND PECAN STREET IN THE CITY OF WEST MEMPHIS,ARKANSAS, DECLARING
AND EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS,application has been made to the City Planning Commission,on June 25,2014,
for a Special Use Permit allowing excavation and the removal of dirt in a R-1, Residential District,
as required by Ordinance 1988, as amended.
WHEREAS, after notice has been published for the time and in the manner as provided by
Ordinance No. 1988, as amended, the matter was heard by the City Planning Commission
Wednesday,June 25, 2014, and the Planning Commission recommended a Special Use Permit be
granted to allow excavation and the removal of dirt in a R-1, Residential District, located
approximately in the 900 block of Walnut Street and Pecan Street in the City of West Memphis,
Arkansas, with the following criteria:
1. Final site plan, development criteria, ingress/egress and construction time frame
shall be subject to the approval of the City Engineer prior to beginning operations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS ARKANSAS:
Section 1: The following described property,to wit:
900 Block of Walnut Street and Pecan Street
A 27.41 acre tract of land being a fractional part of 5th Addition to Westwood Acres
(recorded in Plat Book 2, Page 362)and lying in the SW1/4 of Section 13,T-6-N, R-
8-E, City of West Memphis, Crittenden County, Arkansas and being more
particularly described as follows:
Beginning at a point on the South line of said Section 13, that is 851.96 feet East
of the SW corner, thence S89°45'20"E a distance of 966.08 feet, thence along a
curve that breaks to the left with a radius of 168.23 feet an arc length of 194.84
feet, thence N23°53'10"E a distance of 956.11 feet,thence S89°6'50"E a distance
of 24.10 feet, thence N12°23'42"E a distance of 47.94 feet, thence N66°06'50"W
a distance of 169.60 feet, thence S23°53'10"W a distance of 6.0 feet, thence
N66°06'50"W a distance of 475.0 feet,thence S23°53'10"W a distance of 434.14
feet, thence S47°40'42"W a distance of 112.57 feet, thence S58°13'10"W a
distance of 260.37 feet, thence S77°18'16"W a distance of 42.04 feet, thence
N89°36'50"W a distance of 496.91 feet to a point on the West right-of-way line of
Ordinance No. 2.341

West Walnut Drive, thence S00°23'10"W a distance of 375.0 feet, thence along a
curve that breaks to the left with a radius of 100.00 feet an arc length of 129.08
feet, thence S00°23'10"W a distance of 185.04 feet to the point of beginning
containing 27.41 acres more or less.
and the same hereby is granted a Special Use Permit allowing excavation and the removal of dirt
in a R-1, Residential District, with the following criteria:
1. Final site plan, development criteria, ingress/egress and construction time frame
shall be subject to the approval of the City Engineer prior to beginning operations.
SECTION II: That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION III: EMERGENCY CLAUSE. It having been found and determined by the City
Council of the City of West Memphis, Arkansas, that there is an urgent need to expedite the
construction process in order to avoid inclement fall and winter weather,an emergency is hereby
declared to exist, shall become effective immediately upon its passage and approval.
