AN ORDINANCE TO AMEND SECTION THREE (3) OF ORDINANCE
NO. 1148 OF THE CITY OF WEST MEMPHIS, ARKANSAS,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION 1. The first sentence of Section three (3) of
Ordinance 1148, dated December 15, 1983, is hereby amended
to read as follows:
"There will be a users fee of Fifty Dollars ($50.00)
per container for the period of January 1 through December
31 of each year for containers of up to and including a
capacity of six cubic yards, and a users fee of One Hundred
Dollars ($100.00) per container for the period of January 1
through December 31 of each year for containers in excess
of six cubic yards capacity, for commercial pick-up by a
private firm."
SECTION 2. The remaining portions of Section Three (3)
of Ordinance 1148 shall remain in full force and effect.
SECTION 3. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION 4. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that substantial confusion and uncertainty has
arisen regarding the appropriate fees to be charged for
commercial pick-up by private firms, an emergency is hereby
declared to exist, and this Ordinance being necessary for
the public peace, health, safety and welfare of the
citizens of the City of West Memphis, Arkansas, shall
become effective immediately upon its passage and approval.
