AN ORDINANCE TO AMEND ORDINANCE 403 TO REPEAL THE
EXAMINATION PROCEDURES OF THE BOARD OF EXAMINERS FOR
ELECTRICIANS AND TO REQUIRE ALL ELECTRICIANS PERFORMING
WORK WITHIN THE CITY TO HOLD A VALID MASTER
ELECTRICIAN'S LICENSE FROM THE STATE OF ARKANSAS,
ESTABLISHING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Statutes provide for. the licensing
and regulation of electricians by the Arkansas Board of
Electrical Examiners; and
WHEREAS, it has been recommended by the Building
Inspector that the examination procedu:ces of the City's
B~.~ard of Examiners f'or Electricians be repealed and that
all electricians performing work in the Cit-yr of West
Memphis, Arkans~;.s, bF~ required to hold a ~~alid Master
Elec.t:rician's license isued by the Arkansas Board of
Electrical Examiners;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Section Tcao of Ordinance 403 is hereby- c

The Board of ExaminE~rs shall. adopt such rules and
regulations for the conduct of the business of the Board of
Examiners as may- be ne~~essar~- not in conflict with tlxe
stat.ute~~ of the Stage of P.r•1.arisas, the provisions of t;h:is
Orditlanc_e or with an;.- other Ordinance of the City of l~~-c:st
^lernphis .
Any person, firm or corporation desiring to perform
electrical wort: within the City of t~'est Merripl~:is, A.~~kansas,
shall- hold a valid ^laster E'lectrician's l~i_cense issuE.d by
the _~rliansas Board of 'Electrical IJxam~ners. 'Jo perscn, firm
or• corporation holding a Master Electrician's Li.cen=e shall
permit an~T persc>n other than his employees to work under
his license and/or permits.
?'hc~ Board. of F_.xaminers shall have the authority to hold
hear.i_ngs to determine if the holdcsr_ of a Master
Ele<~trician's License has permitted the u~;e of his license
by another person, firm, p~artr:ership or corporation and may

requir~> suc}i evidence as it shall need to determine if t.he.
holder cf a license has permitted the use of his .license by
another. At :each hearing, if t;he B~.iar•d finds such improper
use by the holder of a :Master Electrici~.n's License, then
and in that event the Board. of Examiners may recommend to
the Arkansas Board of Electrical Examiners that, such
licens:~ be suspended or revolved.
SECTION 2 . Section Five of Orr.lin~tince <}03 is hereby
amended to read as follows:
E~. ery electrician performing el.e:ctrica.l worl•;: i_n the
City of West ~1c.mphis shall give a bond in the penal sum of
One Thousand and No/10CtY•~s Uolars (h1,000.00) to be
approved be the Board of Examiners; said bond shall. be
payable to the (''it,; cf t4~est Memphis, and any citizen who
rna he damaged by imperfect cVorli done by such electrician
for failure to comply with the ordinances of the City of
#v~est 'Memphis, the National Electrical Code and t}-ie statutes
of #.he State of Arkansas and. said bond shall be conditioned
that said electrician shall indemnify and hold harmless the
City of West Memphis and all persons from damages caused by
the negligence or impex~fect caorh done by hi_m o.r his
servants, agents or employees. Said bond shall be ,renewed
each yE•ar and shall expire on December 31 on each year
after its issuance and _f the securit~.~ should bF;come
impaired >v;efore the exl~ira:ioi of #,he bona the Secretary of
the Board shall require additional. bond.
SECTION 3. Section Six of Ordinance 403 is hereby
repealed.
SECTION 4. Secti.orY Nine of Ordinance 403 is herebti-
repealed.
SECTION 5. Section Ten of Ordina:~ce X03 is hereb~r
amended to read as follows:
The Bcard may recommend the suspeiis.ion or revocation of
a license far a violation of the provisions of this
ordinance or arty section thereof or an;,- other ordinance
governing installation or inspection of electrical wiring,
fixtures, apparatus or de~~ices.

SECTION 6. Ail ordinances or parts of ordinances in
conflict hez~ewith are hereby repealed..
SECTION 7. EMERGENCY CLAUSE. 1:t being found and
determined by the City Council of the City of ~ti'est. Memphis,
Arkansas, that this Ordinance i.s necessaryy to insure the
safe inst~.r.llation of elf~ctrical devices in the C:~t~° of West
Memphis, Arkansas, and this Ordinance being further
necessary for the preser~ati<,n of the public peace, health,
safety and welfare of the Citizens of itie~>t Memphis,
Arkansas, shall be in full force and eff~act from and after
its passage and approval.
