2353 ORDINANCE NO. G353
AN ORDINANCE APPROVING THE HIRING OF WILLIE SAMPLEY D/B/A
SAMPLEY TREE SERVICE FOR TREE REMOVAL, CLEAN UP AND STUMP
GRINDING FOR THE CITY OF WEST MEMPHIS, AND FOR OTHER
PURPOSES.
WHEREAS, State Statute 14-42-107(b)(1) states:
No alderman, council member, official, or municipal employee shall be interested,
directly or indirectly, in the profits of any contract for furnishing supplies, equipment, or
services to the municipality unless the governing body of the city has enacted an
ordinance specifically permitting aldermen, council members, official, or municipal
employees to conduct business with the city and prescribing the extent of this authority.
and;
WHEREAS,the City of West Memphis desires to utilize the services of Willie Sampley,
doing business as Sampley Tree Service, to provide tree removal, clean up and stump grinding
for the City of West Memphis; and
WHEREAS, Willie Sampley is related to an employee at West Memphis Utilities, and,
as such, the employee has a"direct or indirect" interest in the profits of such hiring, thereby
requiring prior approval of such hiring by the City Council of the City of West Memphis;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. The City of West Memphis is hereby authorized to hire Willie Sampley for
tree removal, clean up and stump grinding for the City of West Memphis.
