2354 ORDINANCE NO. 01,351-k
AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR EXCAVATION AND THE REMOVAL OF
DIRT IN A R-1, RESIDENTIAL DISTRICT, LOCATED APPROXIMATELY IN THE 900 BLOCK OF
WALNUT STREET AND PECAN STREET IN THE CITY OF WEST MEMPHIS,ARKANSAS, DECLARING
AND EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, application has been made to the City Planning Commission, on October 15,
2014, for a Special Use Permit allowing excavation and the removal of dirt in a R-1, Residential
District, as required by Ordinance 1988, as amended.
WHEREAS, after notice has been published for the time and in the manner as provided by
Ordinance No. 1988, as amended, the matter was heard by the City Planning Commission
Wednesday, October 15,2014,and the Planning Commission recommended a Special Use Permit
be granted to allow excavation and the removal of dirt in a R-1, Residential District, located
approximately in the 900 block of Walnut Street and Pecan Street in the City of West Memphis,
Arkansas, with the following criteria:
1. Final site plan, development criteria, ingress/egress and construction time frame
shall be subject to the approval of the City Engineer prior to beginning operations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS ARKANSAS:
Section 1: The following described property, to wit:
A 12 acre tract of land lying in the SW A of Section 13 and the SE 1/4 of Section 14,
T-6-N, R-8-E, City of West Memphis, Crittenden County, Arkansas and being more
particularly described as follows:
900 Block of Walnut Street and Pecan Street
and the same hereby is granted a Special Use Permit allowing excavation and the removal of dirt
in a R-1, Residential District,with the following criteria:
1. Final site plan, development criteria, ingress/egress and construction time frame
shall be subject to the approval of the City Engineer prior to beginning operations.
SECTION II: That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.

SECTION III: EMERGENCY CLAUSE. It having been found and determined by the City
Council of the City of West Memphis, Arkansas, that there is an urgent need to expedite the
construction process in order to avoid inclement fall and winter weather,an emergency is hereby
declared to exist, shall become effective immediately upon its passage and approval.
