AN ORDINANCE TO AMEND ORDINANCE 1266, THE LAND
SUBDIVISION AND DEVELOPMENT CODE, TO DEFINE
PRIVATE STREETS, TO PROVIDE FOR APPLICATION
OF THE CODE TO MULTIPLE BUILDING SITES AND
FOR OTHER PURPOSES.
WHEREAS, after a public hearing upon due notice and
publication, pursuant to Article VIII, Section 5, of
Ordinance 1266, the West Memphis Land Subdivisian and
Development Code, the Planning Commission has approved and
recommended for adoption amendments to the Land Subdivision
and Development Code to define private streets and to make
the Land Subdivision and Development Code applicable to
multiple building sites;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
Section 1. Article II of the Land Subdivision and
Development Code adopted by Ordinance 1266 is hereby
amended to add the following definition:
Street, private: A cul-de-sac or loop street built
to public street standards, but specifically
allowed as private streets by the Planning
Commission. A private street should not connect
two different public streets.
Section 2. Article III of the Land Subdivision and
Development Code adopted by Ordinance 1266 is hereby
amended to add the following section:
Section 7. Multiple Building Sites
Large scale developments involving the
construction of two or more buildings together
with the necessary drives and accessways which are
not subdivided into customary lots, blocks, and
streets shall be subject to the provisions of this
ordinance. This provision shall also be deemed to
include single principal structures proposed for
addition to an existing multiple building site
development. This provision shall not be deemed to
include developments where the addition of a
single building or structure serves as an
accessory building/structure to a principle use on
the same site. Plans for all such developments
shall be submitted to and approved by the Planning
Commission, whether or not such plat or plan is to
be recorded, and no building permit shall be
,~, issued until such approval has been given. Such
`~~~, plan shall be prepared in sufficient detail to
'~y' show the location of all driveways, curb cuts,
~!~„ service easements, existing and planned utilities,
..~'~~ building locations, side walks, parking areas, and

Section 3. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
