SECTION III: Section 7 District Regulations is amended by
adding the following:
Section 7.4. Lot, yard and height regulations. Section
7.4 is hereby modified by adding the RS-4 and RS-5 Districts:
A. The specific regulations for the RS-4 District are as
follows:
1. Minimum Lot Area - There shall be provided a minimum of
4,000 square feet per dwelling unit on an overall basis. Said
density requirement may be met through a combination of both the
individual lot area and/or any additional common open space area
which is allocated through proper legal restrictions to the mutual
and common use and enjoyment of all individual lot owners within
any single development proposed for attached single-family use.
In such cases where common open space area is provided, then it
shall be equally allocated to all units within the project in order
to determine average density. Said provision of common open space
is not mandatory in the district.
In such cases where common open space is not provided, then
the average of the lot sizes included in any single platted
development for zero lot line purposes and/or rezoning application
for said purposes must meet the average of 4,000 square feet per
unit. In any case, however, whether common open space is provided
or not, the absolute minimum single lot size shall be 20 feet wide
by 110 feet deep.
2. Coverage - The maximum lot coverage shall be 50~.
3. Yards
a. Front -- 25 feet
b. Rear Yard -- 25 feet
c. Side Yard -- Side yards shall be required wherein
there is an exterior corner lot, or if needed to provide breaks between
building groups, or in the interior lot which may be adjacent to other
existing development that is not included within the RS-4 Attached
Single-Family District. In such cases where a lot is an interior
lot, abutting to an existing development that is not included in the
(2)
RS-4 Attached Single-Family District, then there shall be a minimum
side yard equal to or greater than the side yard required of the
adjacent residential property. For exterior corner lots, there
shall be a side yard provided of at least 15 feet, regardless of
whether the corner lot backs up to an abutting rear yard or is
adjacent to an abutting side yard.
Furthermore, in no case shall more than six (6) individual
dwelling units be attached to one another without providing for a
break in building groups. Said break shall provide for an open
space of at least ten (10) feet, and this 10-foot side yard shall
be provided as an additional width on the last lot included in said
building group.
4. Height - The Maximum height for any structure in the RS-4
Attached Single-Family District shall be three (3) stories or 36
feet in height.
B. The specific regulations for the RS-5 District are as
follows:
1. Minimum Lot Area - The minimum lot area shall be 4,950
square feet per lot. All lots shall be at least 45 feet wide at the
front building line and shall have a minimum depth of 110 feet.
2. Lot Coverage - The maximum lot coverage shall be 50~.
3. Yards - The following yard minimum setbacks are established:
a. Front --
b. Rear Yard --
25 feet
25 feet for rear yard if
dwellings are unattached at the rear yard lot line.
c. Side Yard -- There shall be no side yard
requirement wherein single-family units to be constructed within this
zone are to be attached. If dwellings are not to be attached at the
side, then a minimum 10-foot side yard requirement shall be provided
on one side of the dwelling. This allows for each detached dwelling
unit to be "offset" to one side of the lot so as to create a usable
''~ side yard of ten feet or more in width. However, where lots are
platted for zero lot line use, any lot located adjacent to any other
(3)
G'
residential zone must provide for a side yard of at least 10 feet
on the side directly abutting the other zone. Furthermore, in no
case may more than four (4) dwelling units be attached without
providing sufficient separation between building groups of at least
10 feet. In such cases of an exterior corner lot backing up to an
abutting side yard, then there shall be a 25-foot setback provided
on the exterior side. In cases where the side yard for an exterior
corner lot backs up to an abutting rear yard, then a 10-foot setback
shall be provided.
4. Height - The maximum height for any structure in the RS-5
Zero Lot Line District shall be three stories or 36 feet in height.
SECTION IV: Section 8 Permitted Uses in Zoning Districts is
amended by adding the following to Section 8.2:
Dwelling - Attached Single-Family. Only single-family attached
dwellings shall be permitted in the RS-4 Attached Single-Family
District. Other uses permitted either by right or as a conditional
use in other RS zones within the City of West Memphis' Zoning Code

RS districts of the City of West Memphis' Zoning Code shall be
permitted in the RS-5 Zero Lot Line District. Additionally, single-
family attached dwellings shall be permitted in this district. Further-
more, all uses which are conditionally permitted in the RS district
shall also be conditionally permitted in the RS-5 Zero Lot Line
District.
SECTION V: All ordinances or parts of ordinances in conflict
with this ordinance are hereby repealed.
