ORDINANCE NO.
AN ORDINANCE VACATING A PORTION OF CHURCH
STREET IN 4th RICH EASTERN ADDITION AND WALKER.
ESTATE SUBDIVISION TO THE CITY OF WEST MEMPHIS,
AR.KANSA S
WHEREAS, a Petition was duly filed with the City Council of the
City of West Memphis, Arkansas, on the :~.5~ day of May, 1982, asking
the City Council to vacate and abandon the hereinafter described portion
of Church Street designated on the plat of the 4th Rich Eastern Addition
to said City, now appearing of record in Plat Book 2 at page 161 in the
office of the Recorder of Crittenden County, Arkansas, and on the plat of
the Walker Estate Subdivision to said City, now appearing of record in
Plat Book 2 at page 201 in the office of the Recorder of Crittenden County,
Arkansas.
WHEREAS, after due notice as required by law, the Council has,
at the time and place mentioned in the Notice, heard all persons desiring
to be heard on the question and has ascertained that the portion of Church
Street hereinafter described has heretofore been dedicated to the public
use as a street herein described; has not been actually used by the public
generally for a period of at least five years; that all the owners of the pro-
perty abutting upon the portion of Church Street to be vacated have filed
with the Council their written consent to such abandonment; and that public
interest and welfare will not be adversely affected by the abandonment of
such street.
NOW, THEREFORE, be it ordained by the City Council of the City
of West Memphis, Arkansas:
SECTION 1. The City of West Memphis, Arkansas, hereby
releases, vacates and abandons all its rights, together with the rights
of the public generally, in and to the street designated as follows:
That portion of Church Street running in an east-west
direction between the easterly right-of-way line of 36th
Street and the westerly right-of-way line of Club Road
2.
within 4th Rich Eastern Addition to the City of West ,
Memphis, Arkansas, as the same is shown on a plat
entitled "4th Rich Eastern Addition, West Memphis,
Arkansas", of record in Plat Book 2 at page 161 of
the records of Crittenden County, Arkansas, and the
Walker Estate Subdivision as the same is shown on a
plat of the Walker Estate of record in Plat Book 2 at
page 201 of the records of Crittenden County, Arkansas,
particularly described as follows, to-wit:
Beginning at the northwest corner of Lot 1, Block 5
of 4th Rich Eastern Addition, thence east to the north-
east corner of Lot 14 of the Walker Estate Subdivision,
thence north to the southeast corner of Lot 15 of the
Walker Estate Subdivision, thence west to the south-
west corner of Lot 13, Block 1 of 4th Rich Eastern
Addition, thence south to the point of beginning,
RESERVING THEREFROM, HOWEVER., easements
and rights-of-way for the existing 5-foot utility ease-
ment located west of the east lines of Block 5 of 4th
Rich Eastern Addition and of Block 1 of 4th Rich
Eastern Addition, all as shown on a plat entitled
"4th Rich Eastern Addition, West Memphis, Arkansas",
appearing of record in Plat Book 2 at page 161 of the
records of Crittenden County, Arkansas.
SECTION 2. A copy of the Ordinance duly certified by the City
Clerk shall be filed in the office of the Recorder of the county and
recorded in the deed records of the county.
SECTION 3. This Ordinance shall take effect and be in force
from and after its passage.
