ORDINANCE N0.
AN ORDINANCE TO REZONE THAT PART OF THE SOUTH HALF OF THE SOUTHEAST
QUARTER OF SECTION NINE, TOWNSHIP SIX NORTH, RANGE NINE EAST,
PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT AN IRON STAKE IN
THE NORTH LINE OF THE RIGHT-OF-WAY OF UNITED STATES HIGHWAY NO, 70
WHICH POINT IS 1155.4 FEET WEST OF THE EAST LINE OF SAID SECTION
NINE MEASURED ALONG SAID HIGHWAY LINE, AND IS THE SOUTHWEST CORNER
OF THE TRACT TAKEN BY ARKANSAS STATE COMMISSION IN CAUSE N0. 4897 _
IN THE CRITTENDEN CIRCUIT COURT AS THE RIGHT-OF-WAY FOR THE OVER-
PASS CONNECTING THE NEW BY-PASS HIGHWAY N0. 61 WITH SAID HIGHWAY
N0. 70, AND FROM SAID POINT OF BEGINNING RUN THENCE WEST ALONG THE
NORTH LINE OF THE RIGHT-OF-WAY OF SAID HIGHWAY NO. 70 A DISTANCE OF
300 FEET TO AN IRON STAKE, THENCE NORTH AT RIGHT ANGLES TO SAID
HIGHWAY RIGHT-OF-WAY LINE 300 FEET TO AN IRON STAKE, THENCE EAST
PARALLEL TO SAID HIGHWAY RIGHT-OF-WAY LINE 300 FEET TO AN IRON STAKE,
THENCE SOUTH 300 FEET TO THE POINT OF BEGINNING.
WHEREAS, application was made to the City Planning Commission to
rezone the hereinafter described property and after notice having
been published for the time and in the manner as provided by Ordinance
No. 1033 the matter was heard by the City Planning Commission and no
persons appearing to protest the same the Planning Commission
recommended that said application be granted:
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,
ARKANSAS:
SECTION I: That the following described property, to wit:
That part of the South Half of the Southeast Quarter of Section
Nine, Township Six North, Range Nine East, particularly described
as follows: Beginning at an iron stake in the north line of the
right-of-way of United States Highway No. 70 which point is 1155.4
feet west of the east line of said Section Nine measured along
said highway line, and is the southwest corner of the tract taken
by Arkansas State Commission in Cause No. 4897 in the Crittenden
Circuit Court as the right-of-way for the over-pass connecting the
new by-pass Highway No. 61 with said Highway No. 70, and from said
point of beginning run thence west along the north line of the
right-of-way of said Highway No. 70 a distance of 300 feet to an
iron stake, thence north at right angles to said Highway right-of-
way line 300 feet to an iron stake, thence east parallel to said
highway right-of-way line 300 feet to an iron stake, thence south
300 feet to the point of beginning.
be and the same is hereby rezoned M-1 Limited Industry.
SECTION II: That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
