2360 ORDINANCE NO. a 360
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
PURCHASE OF TWO STRYKER EMS POWER COTS AND
ACCESSORIES,DECLARING AN EMERGENCY,AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible
or practical; and
WHEREAS, the City of West Memphis is in need of acquiring a two Stryker EMS
Power Cots and accessories; and
WHEREAS, the City Council determines that competitive bidding should be waived for
the reason that the West Memphis Fire Department currently has two employees who are unable
to work due to back injuries,resulting in substantial overtime costs to the Fire Department and
that the acquisition of the two Stryker Power Cots and accessories should greatly reduce the
possibility of additional employees incurring back injuries from lifting, loading and unloading
patients and competitive bidding under such circumstances would not be feasible or practical;
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for the purchase two Stryker EMS
Power Cots and accessories, for a total cost of$32,925.00, for use by the West Memphis Fire
Department to reduce or eliminate the possibility of injury resulting from lifting, loading and
unloading patients. These items to be purchased from Stryker EMS.
SECTION 2. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that the West Memphis Fire Department
currently has two employees who are unable to work due to back injuries, resulting in substantial
overtime costs to the Fire Department and that the acquisition of the two Stryker Power Cots and
accessories should greatly reduce the possibility of additional employees incurring back injuries
from lifting, loading and unloading patients, an urgent and immediate need exists to reduce the
possibility of additional employees incurring back injuries from lifting, loading and unloading
patients, an emergency is hereby declared, and this ordinance being necessary for the
preservation of the peace, health, safety and welfare of the citizens of West Memphis, Arkansas,
shall be in full force and effect from and after the date of its passage and approval.
SECTION 3. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
