Wheeler Subdivision now appearing of record in
Plat Book 2 at pages 113 and 114 in the office
c~i= the Recorder of Crittenden County, Arkansas,
b<~ginning at the west line of Ingram Boulevard
and running west to the east line of 20th Street
and abutted on the north by Lots 1, 2, 3, 4 and
5 and on the south by Lots 6, 7, 8, 9, 10, 11
and 1.2 in Block '7 of Wheeler Subdivision,
SUBJECT, however, to existing easements for
public utilities in that portion of the alley
abutted on the north by Lots 3, 4 and 5 and on
the south by Lots 6, 7 and 8. The City shall
have th~:~ continued us.=~ of this portion of the
vac.at.c:d alley as an easement for public utilities.
Section 2. A copy of the ordinance duly certified by the
City Clerk shall be filed in the office of the Recorder of
Crittenden County, Arkansas, and recorded in the deed records
cif: the County .
Ser_tio:r. 3. Emergency Clause: It is hereby found and de-
c:! a.r,~d by the Ci ~`I Council of the City of West Memphis that the
~_ rop:~r t~,,- through which this alley runs is in the process of
d~:~el::>pment and this ordinance is necessary for the owners of
~_'.e i~raperty to be able to properly utilize such property and
F:~~~ `~hF: c:~rc;wtli and expansion of the City of West Memphis, and
r_:-ia~l. the passage of this ordinance is in the interest of the
~.-u;~:Lic Y~ealth, peace, safety and welfare of the .City of West
c~eznpi:.is 4~nd the inhabitants thereof. Therefore, an emergency
i`J~ hereby declarE:d to exist and this ordinance shall take effect
and be in force immediately from and after its passage.
