AN ORDINANCE TO AMEND SECTION THREE (3)
OF ORDINANCE N0. 1069, ESTABLISHING TERMS
OF THE WEST MEMPHIS UTILITY COMMISSIONERS,
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Section Three (3) of Ordinance No. 1069,
is amended as follows:
"Terms. The terms of the Commission Members
of the West Memphis Utility Commission shall
be as follows:
Three (3) members to serve for one (1) year terms;
Three (3) members to serve for two (2) year terms;
One (I) member to serve for a three (3) year term.
The terms of the members elected under this Ordinance
shall be determined by draw.
At the expiration of the term of any .Utility
Commissioner elected under this Ordinance, the
new Commissioner shall serve for a three (3)
year term, and shall be eligible for
reappointment.
Vacancies caused by death, resignation or other
reasons shall be filled by a majority vote of the
City Council."
SECTION 2. Emergency Clause. It having been found
and determined by the City Council of the City of West Memphis,
Arkansas, that there is a need for longer terms for members
of the Utility Commission, an emergency is hereby .declared to
exist, and this Ordinance being necessary for the public peace,
safety, and welfare of the Citizens of West Memphis, Arkansas,
shall become effective immediately after its passage and
approval.
