ORDINANCE NO.
AN ORDINANCE VACATING AND ABANDONING A CERTAIN UTILITY
.EASEMENT IN THE CITY OF WEST MEMPHIS, ARKANSAS
WHEREAS, a Petition was duly filed with the City Council
of the City of West Memphis, Arkansas to vacate and abandon
the utility easement more particularly described as follows:
The WEst 75 feet of the South Half of Lot 8
in Block 7 of the Compress Subdivision to the
City of West Memphis, Crittenden County,
Arkansas;-and
WHEREAS, after due notice as required by law, the City
Council has; at the time and place mentioned in the notice
heard all persons desiring to be heard on the question and
Ilhas ascertained that the easement herein described has not been
actually used by the general public for a period of at least
five years immediately preceding the filing of said petition
to vacate and abandon said easement; that all the owners of the
'property abutting upon the easement be vacated have filed with
the Council their written consent to such abandonment; that
the public interest and welfare will not be adversely affected
by the abandonment of such easement;
NOW, THEREFORE, BE IT ORDAINED THAT THE CITY COUNCIL
'OF THE CITY OF WEST MEMPHIS, ARKANSAS:
Section 1: The City of West Memphis, Arkansas,
hereby releases, vacates and abandons all of its
rights, together with the rights of the public
generally, in and to the following described
easement:
The West. 75 feet of the~South Half of Lot 8
in Block 7 of the Compress Subdivision to the
City of West Memphis, Crittenden County, Arkansas.
Section 2: A copy of the ordinance, duly certified by
the City Clerk shall be filed in the office of the
~ap~s.

Section 3. Emergency Clause. It having been found
and determined by the City Council of the City of West
Memphis, Arkansas, that there is a need for the Easement
described in this Ordinance, and that the building permits
are ready to be issued, an emergency is hereby declared
to exist, and this Ordinance being necessary for the
preservation of the public peace, safety, health and
welfare of the Citizens of the City of West Memphis,
shall become effective immediately upon its passage and
approval.
