A RESOLUTION CERTIFYING THE CONDEMNATION AND
REMOVAL OF ALL BUILDINGS AND STRUCTURES,LOCATED AT
974 WEST MCAULEY AND 900 EAST BARTON, CONSTITUTING A
NUISANCE WITHIN THE CITY OF WEST MEMPHIS CORPORATE
LIMITS.
WHEREAS, Chapter 12.64 of the West Memphis Municipal Code provides a
procedure for the City Council to condemn buildings and structures which constitutes a
nuisance by adoption of a resolution setting out a description of the buildings and
structures, the name or names, if known, of the owners thereof, and the reason said
buildings and structures have been condemned as a nuisance; and
WHEREAS,provided in Chapter 12.64 of West Memphis Municipal Code,
notice of the condemnation of the buildings and structures is to be provided by mailing a
certified copy of the resolution to the owner or owners if their whereabouts are known or
to their last known address and by posting a copy of the resolution at a conspicuous place
on said buildings and structures, and if the whereabouts or last known address are
unknown the posting of the resolution will suffice as notice; and
WHEREAS, provided in Chapter 12.64 of West Memphis Municipal code, the
buildings and structures constituting a nuisance will be torn down and removed by the
building inspector or his duly designated representative if it has not been torn down and
removed, or said nuisance otherwise abated within thirty (30) days after posting the true
copy of the resolution at a conspicuous place on said buildings and structures constituting
a nuisance; and
WHEREAS, if the City has any net costs in removal of any buildings and
structures, the City shall have a lien placed on the property;
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS,THAT, the buildings and structures
described in Exhibit "A" attached hereto and incorporated herein by reference are hereby
declared to be a nuisance for the reason or reasons therein set forth.
BE IT FURTHER RESOLVED THAT, if the buildings or structures
constituting a nuisance has not been torn down and removed or the nuisance otherwise
abated within (30) days of the posting of a true copy of this resolution in a conspicuous
place on said buildings and structures, the building inspector or his duly designated
representative is authorized and directed to tear down and remove the buildings and
structures constituting a nuisance and to cause a lien to be placed on the property for any
net costs incurred by the city for the removal of said buildings and structures.
