ORDINANCE TO AMEND ORDINANCE N0. 1033,
AND WEST MEMPHIS COMPREHENSIVE PLAN,
ZONING CODE, REPORT NO. 11.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:
SECTION 1. Section 8.2, Permitted Uses, shall be amended
to read, Off-Street Parking where Off-Street Parking: Required.
SECTION 2. Section 10.225, Location, shall be amended to
read as follows:
"Such off-street parking space may occupy all or any part
of any required yard or court space unless otherwise
modified by this section. The required off-street
parking for any new use structure or building shall be
on the same lot with the building or within three
hundred feet (300') thereof. The distance to any parking
area as herein required shall be measured between the
nearest point of the off-street parking facility and the
nearest point of the building said parking area or
facility is to serve. Off-site parking shall not exceed
twenty-five per cent (25%) of the total number of spaces
required by this section. Such off-site parking space
shall be deemed to be required parking space associated
with the permitted use and it shall not thereafter be
reduced or encroached upon in any manner. Furthermore,
when detached parking facilities or satellite parking
lots are provided, they shall be located on property
which is zoned to allow the principal use to which this
parking will serve, or they must be approved by the Board
of Adjustment."
SECTION 3. Section 10.226, Number of Off-Street Parking
Spaces Required, shall be amended to read as follows:
"The number of off-street parking spaces required for
each use is set forth in the Parking Spaces Re uired
Column in the Tables of Permitted Uses. The number of
parking spaces required for a use not listed herein
shall be the same as for a similar use which is listed.
Where the required number of spaces cannot be ascertained
by this method, or the applicant and the City Staff
cannot agree, the matter shall be submitted to the ,,;t_**_

SECTION 4. Section 10.227, Paragraph 4, (Sec. 10.22? (4) ),

Surfacing, shall be amended as follows:
"Pavement Requirements. Every parcel of land, which
after the effective date of this Ordinance, is changed
to a parking area, automobile, other vehicle or trailer
sales or storage area, or automobile or motor vehicle
service station, garage, or other vehicular use area
shall be paved where subject to wheeled traffic. The
minimum pavement requirements shall be designed for _,.
intense traffic use with asphaltic concrete hot mix
surface, or a double surface treatment, or concrete
surface. Any off-street parking area shall be paved
as specified above and shall be so graded and drained
as to dispose of all surface water accumulated within
the area, and shall be so arranged and marked as to
provide for orderly and safe loading or unloading
and parking and storage of vehicles. The foregoing
requirements with respect to surfacing shall not apply
to a temporary parking area.
SECTION 5. All Ordinances or Parts of Ordinances in
conflict herewith, are hereby repealed.
