ORDINANCE NO. t ~ 3~
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR
GRASS CUTTING FOR CITY MUNICIPAL PROPERTIES
AND FOR OTHER PURPOSES
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and,
WHEREAS, there are many items necessary for the City's use where competitive bidding
is deemed not feasible or practical; and,
WHEREAS, T. C. Lawn and Landscape was the successful low bidder for mowing
services for City Municipal Properties per bid opening of April 1, 1999, for a price of $1,550.00 per
cutting; and,
WHEREAS, Section 8, paragraph 3 of the Terms and Conditions of said Bid Notice states
that the Contract will be in effect until December 31 of the year executed, and that the City of West
Memphis reserves the right to renew the contract for not more than one additional year; and,
WHEREAS, the City of West Memphis desires to renew the contract with T. C. Lawn and
Landscape at the same rate for the year 2000; and,
WHEREAS, competitive bidding under such circumstances would not be feasible or
practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City,
described as follows:
Grass cutting services provided by T. C. Lawn and Landscape for the year 2000 at the
current rate of $1,550.00 per cutting.
