AN ORDINANCE TO REZONE CERTAIN PROPERTY IN THE CITY OF WEST
MEMPHIS, LOCATED ALONG MOUND CITY ROAD, FROM I-1, LIMITED
INDUSTRIAL TO C-1-F, GENERAL COMMERCIAL DISTRICT -FIREWORKS,
DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.
WHEREAS, application was made to the City Planning Commission to rezone the
herinafter described property, and after notice having been published for the time and in
the manner as provided by Ordinance No. 128, as amended, the matter was heard by the
City Planning Commission on Wednesday, May 31, 2000, and the Planning
Commission recommended that the application be approved to rezone the following
described property from I- l ,Limited Industrial District, to C-1-F, General Commercial
District -Fireworks:

Leal: East 400' of the E 1/2 W 1/2 NW 1/4 North of Interstate 40 right-of--way and the west
400' ofthe W 1/2 E 1/2 NW 1/4 North of Interstate 40 ritht-of--way all in Section 10, t-6-N, R-9-
E, City of West Memphis, Crittenden County, Arkansas, Containing 24.14 acres more or less
WHEREAS, no persons appeared to protest against said zoning as requested; and
WHEREAS, the City Council of the City of West Memphis approved said petition
and recommends that said rezoning be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. That the following property now zoned as I-l, Limited Industrial District,
be and the same is hereby, rezoned C-1-F, General Commercial District -Fireworks, as follows:
Common: approximately 1250 - 1303 Ivlound City Road
Legal: East 400' of the E 1/2 W 1/2 NW 1/4 North of Interstate 40 right-of--way and the
west 400' of the W 1/2 E 1/2 NW 1/4 North of Interstate 40 ritht-of--way all in Section 10, t-
6-N, R-9-E, City of West Memphis, Crittenden County, Arkansas, Containing 24.14 acres
more or less
SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby
aled.

SECTION 3. It having been found and determined by the City Council of the City of
West Memphis, Arkansas, that there is an urgent need by the City of West Memphis and that it is
necessary to have this in effect immediately prior to the beginning of the fireworks season which is
scheduled to start June 20, ?000, and to further effect the terms of the settlement agreement
between American Fireworks, Inc., and the City of West Memphis, Arkansas, an emergency is
hereby declared to exist, and this Ordinance, being necessary for the preservation of the public
peace, health, safety and welfare of the citizens of West Memphis, Arkansas, shall be in full force
and effect from and after the date of its passage and approval.
