' AN ORDINANCE TO LEVY AN ANNUAL PRIVILEGE LICENSE UPON ALL PERSONS, PARTNERSHIPS, ASSOCIATIONS, b'IRMS, AND CORPORATIONS ENGAGED IN CARRYING ON OR FOLL04JING CERTAIN TRADES, BUSINESSES, PROFESSIONS, VOCATIONS, AND/OR CALLINGS WITHIN THE CORPORATE LIMITS OF THE '~` CITY OF WEST MEMPHIS, ARKANSAS: TO PROVIDE THE TIME ~ FOR PAYMENT OF SUCH PRIVILEGE LICENSE: TO PROVIDE PENALTIES FOR NONPAYMENT THEREOF: DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: Section 1. Ordinance No. 78~ is hereby repealed. Section 2. That an annual Privilege License, be, and the same is, hereby levied and assessed upon every person, partnership, association, firm or corporation, engaged in carrying on or following within the corporate .limits of the City of West Memphis, Arkansas, each of the following trades, businesses, professions, vocations, and/or callings, an amount set opposite the trade, business, profession, vocation i and/or calling herein mentioned, which annual privilege license shall be in addition to any other license or tax levied by any other Ordinance of the City of West Memphis, and said privilege license shall be due on and payable January 1st of each year by all persons, partnerships, associations, firms and/or corporations then engaged in any business for which a privilege license is charged, and said privilege license shall become delinquent AFTER January 31, 1980, and each year thereafter on January 31st. Any person, partnership, association, firm and/or corporation engaging in any business for which a privilege license is payable under this Ordinance subsequent to January 1st of any year shall immediately. (APPLY-FOR) and pay the Privilege License provided for in this Ordinance, and if not paid within thirty (30) days after such person, partnership, association, firm and/or corporation begins such business, shall be delinquent and subject to the penalties herein provided. 1: ~e Section 3. Where two or more businesses, each of which require the payment of a separate license, shall be carried on by any person, partnership, association, firm and/or corporation upon the same premises, the license shall be an amount equal to the highest license provided for ' w 4 ~. carrying on of any such businesses separately, PLU5 one-half (1/2) of the license provided for carrying on each of the other businesses separately. All licenses provided herein shall be for the Calendar Year beginning January lst, provided that said license is issued prior to June 30th. If such trade, business, profession, vocation and/or calling should be begun after~June 30th, and prior to September 30th, the charge shall be one-half (1/2) of that for the Calendar Year. If such trade, business, profession, vocation and/or calling should be begun after September 30th, the charge shall be one-fourth (1/4) of that for the Calendar Year. All licenses issued under the provisions of this Ordinance shall expire at Midnight on December 31st of the year for which said licenses may be issued. Section 4. The Privilege Licenses herein provided for shall be due and payable on January 1st of each year, and shall expire on December 31 following. Said License ~.. shall be payable to the City Clerk who shall issue the License in duplicate. Section 4 of Ordinance No. 9~.Zis,amended in part by deleting the following in its entirety: vbusinesses ,_aze allowed ten (10) days after opening to obtain the. licenses requirEd. as assessed in this Ordinance.." ~ b __ _ __._ _ The City Clerk shall-make monthly settlements with the. _ ~' Treasurer and pay to him all License Fees collected. Section 5. The license provided for herein shall not be transferable from any person, persons, partnership, association, firm and/or corporation to another person, persons, partnership, association, firm and/or corporation. 2. Section 6. The Privilege Licenses provided for in this Ordinance, when paid for any period therein, shall not be returnable, in case the Licensee, for any reason surrenders , or discontinues his said business; and, any sum so paid shall not be returnable to any person, partnership, association, firm and/or corporation. Section 7. The City Clerk of the City of West Memphis, Arkansas, shall be authorized and empowered to make a refund of any OVERCHARGE, MISTAKE, or ERROR of Privilege License to any individual, partnership, association, firm and/or corporation where it is necessary and proper to make said refund. The City Clerk may upon written application ' therefor, and with the approval of, the Mayor endorsed thereon, extend the time for the payment of any license for any period, not exceeding thirty (30) days, but only one (1) extension of time shall be granted. Ordinance No. 1230 passed November 7, 1985 SECTION 2. Section 9 of Ordinance No. 987 is amended as follows: • "Any person, partnership, association, firm and/or corporation, who shall engage in, carry on, or follow any of the trades, businesses professions, vocations and/or callings specified herein, within the corporate limits of the City of West Memphis, as herein prescribed, or who have been engaged in a trade, business, profession, vocation and/or calling and fails to pay his Privilege License before February 1 of each year, shall be deemed guilty of a violation of this Ordinance and upon conviction thereof, shall be assessed and fined a ten per cent (10%) penalty of the license due; and, there will be a twenty-five (25%) penalty of the License due if not paid before March 1 of each year, for the trade, business, profession, vocation and/or calling." -- -__ Ordinance No. 1230 passed November 7 1985 SECTION 3. It is hereby declared to be the intention of the City Council that each word, phrase, sentence, paragraph, section, or sub-section shall be a separate provision of the Ordinance, and in the event that any word, phrase, sentence, -'~ paragraph, section, or sub-section of this Ordinance shall be declared unlawful, or invalid, such declaration shall not affect the remaining portions of this Ordinance and all other provisions hereof shall remain in full force and effect. Section 12. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed as 'herein set forth. Section 13.
