AN ORDINANCE GRANTING A SPECIAL USE PERMIT IN A C-2, OPEN DISPLAY
COMMERCIAL DISTRICT, TO ALLOW THE CONSTRUCTION OF A 199 FOOT
MONO-POLE COMMUNICATION TOWER, AT 2520 E. BROADWAY, WEST
MEMPHIS, ARKANSAS.
WHEREAS, an application has been made to the City Planning Commission to
allow a Special Use Permit of a 199 foot mono-pole communication tower in a C-2, Open
Display Commercial, as required by Ordinance 1258, as amended.
WHEREAS, after notice has been published for the time and in the manner as
provided by Ordinance No. 1258, as amended, the matter was heard by the City Planning
Commission, on June 28, 2000 and the Planning Commission recommended that a
Special Use Permit be granted to Tower Ventures, III, LLC, for said property, to permit a
a 199 foot mono-pole communication tower in a C-2, Open Display Commercial District,
subject to the following supplemental conditions:
1. Removal of 175 feet of chain link fence along E. Broadway;
2. Installation of 13 evergreen trees along E. Broadway and 15 evergreen trees
around the base of the tower;
3. Design Review Commission approval on fencing.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1: That the following described property, to wit:
2520 E. Broadway, West Memphis, Arkansas
be, and the same hereby is granted a Special Use Permit, permitting a 199 foot mono-pole
communication tower in a C-Z, Open Display Commercial District, subject to the following
supplemental conditions:
1. Removal of 175 feet of chain link fence along E. Broadway;
2. Installation of 13 evergreen trees along E. Broadway and 15 evergreen trees
around the base of the tower;
3. Design Review Commission approval on fencing.
SECTION II: That all Ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
