AN ORDINANCE IN PURSUANCE OF THE AUTHORITY GRANTED
BY THE LEGISLATURE OF THE STATE OF ARKANSAS IN ACT
186 of 1957, PROVIDING FOR TH$ ADOPTION BY REFERENCE
OF A CODE OF ZONING REGULATIONS AND ZONING MAP FOR
THE CITY OF WEST MEMPHIS, ARKANSAS; REPEALING
ORDINANCE N0. 715 OF 1972, AND ALL OTHER ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; PROVIDING PENALTY FOR VIOLATION
OF SAID CODE; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,
ARKANSAS:
Section 1. There is hereby adopted by the City Council of
the City of West Memphis, Arkansas, pursuant to Act 186 of the
1957 Acts of Arkansas, a Code of Zoning Regulations which consist
of text and Zoning Map by reference entitled:
"ZONING REGULATIONS FOR THE CITY OF WEST MEMPHIS, ARKANSAS. A code
in pursuance of the authority granted by the legislature of the State
of Arkansas in Act 186 of 1957, establishing Zoning Regulations which
consist of text and Zoning Map in accordance with a Land Use Plan;
regulating the location, height, bulk, number of stories and size
of buildings; regulating open spaces, lot coverage, density of
population; regulating the uses of land, buildings and structures
'`~""` within the City of West Memphis; dividing said areas of the City

' of West Memphis into districts and zones; regulating the erection,
construction, reconstruction, conversion, alteration of buildings
and structures; providing for uniform regulations for each class or
kin~_ of building throughout each district; and providing for a
Board of Adjustment."
Section 2. Ordinance No. 715 of the City of West Memphis,
Arkansas, and all other ordinances or parts of ordinances in conflict
herewith to the extent of such conflict are hereby repealed.
Section 3. Any person, firm, or corporation who shall violate
any of the provisions of this Code or fail to comply substantially
therewith, or who shall violate or fail to comply substantially with
,, any order or regulation made thereunder, or who shall build in
violation of any detailed statement of specification or plans
submitted and approved thereunder, or any certificate or permit
issued thereunder, shall be guilty of a misdemeanor and upon
conviction thereof shall be fined not more than $25.00 for any
specified offense or violation of this ordinance, or double that sum
for each repetition of such offense or violation of this ordinance.

If a thing prohibited or rendered unlawful is in its nature
continuous in respect to time, the fine or penalty for allowing
the continuance thereof, in violation of this Code, shall not exceed
$15.00 for each day that the same may be unlawfully continued.
Section 4. Three (3) copies of such Zoning Regulations for
the City of West Memphis, Arkansas, which consists of text and
Zoning Map, shall be kept on file in the office of the City Clerk
pursuant to the provisions prescribed by Act 36, Acts of Arkansas,
1949 for public inspection and shall so remain on file at all
times hereafter.
Section 5. It being found and determined by the City Council
of the City of West Memphis, Arkansas, that the present zoning code
and regulations heretofore existing have been declared invalid by
the Chancery Court, Crittenden Councy, and there is immediate need
for a Zoning Ordinance and a Zoning Map for the City of
West Memphis, Arkansas, an emergency is declared to exist, and this
Ordinance being necessary for the public peace, health, and welfare
of the citizens of West Memphis, Arkansas, shall become in full
force and effect from and after its passage and approval.
