2408 ORDINANCE NO. 24°$
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
RE-CHASSISING OF THE EXISTING JET A REFUELER FOR THE WEST
MEMPHIS MUNICIPAL AIRPORT, DECLARING AN EMERGENCY AND FOR
OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible or
practical; and
WHEREAS, fuel sales are the primary revenue source for the West Memphis Municipal
Airport and a refueler truck is a much needed piece of equipment; and
WHEREAS,the rechassising of the existing refueler truck and refitting it with new
controls, hose reel motors, interlocks and the primary and secondary pilots being rebuilt is the
most affordable option; and
WHEREAS, there are only a few companies in the Unites States that customize trucks
for aviation refueling and American Refueler Equipment Co., Inc., is one of the few companies
and is the closest in location and competitive bidding under such circumstances would not be
feasible or practical;
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City,
described as follows:
Re-chassising the existing Jet A refueler by American Refueler Equipment Co., Inc., at a
cost of$71,967.00.
2. EMERGENCY CLAUSE. It having been found and determined by the City Council
of the City of West Memphis, Arkansas, that there is an urgent and immediate need by the City
of West Memphis and the West Memphis Municipal Airport to re-chassis the existing Jet A
refueler so the airport will be able to accommodate the customers of the West Memphis
Municipal Airport and that time is of the essence, an emergency is hereby declared to exist, and
this ordinance being necessary for the preservation of the public health, safety, and welfare of the
citizens of West Memphis, Arkansas, shall be in full force and effect from and after the date of
its passage and approval.
