2410 rrnrr ORDINANCE NO. Zy 10 AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR A STRYKER POWER LOAD SYSTEM FOR THE WEST MEMPHIS FIRE DEPARTMENT,DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical; and WHEREAS, there are many items necessary for the City's use where competitive bidding is deemed not feasible or practical; and WHEREAS, the West Memphis Fire Department is in need of purchasing a power load system for a fire department unit and Stryker is the only company that offers on-site installation,and competitive bidding under such circumstances would not be feasible or practical; NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: 1. That competitive bidding be waived for the following items to be used by the City, described as follows: Stryker Power Load System for a fire department unit to be purchased from Stryker for $22,991.81. 2. EMERGENCY CLAUSE. It having been found and determined by the City Council of the City of West Memphis,Arkansas,that there is an urgent and immediate need by the City of West Memphis and the West Memphis Fire Department to purchase the Stryker Power Load System for an existing unit to keep the unit in service and to meet the needs of the citizens of the City of West Memphis and that time is of the essence,an emergency is hereby declared to exist,and this ordinance being necessary for the preservation of the public health, safety,and welfare of the citizens of West Memphis, Arkansas, shall be in full force and effect from and after the date of its passage and approval. Each unit fitted will be at the cost of $2,000.00; this is for center mounted units. Side mounted units will be installed at a cost of $2,000.00. The project is for One (1) Stryker Power Load System to be installed on site for a total of $2,000.00 for center mounted units. If the above referenced system(s) needs to be side mounted, there will be an additional fee of $0 per unit. This price also includes the mass casualty option installed as well. OBJECTIVE Inst-A-Tech LLC will install Stryker Power Load System(s) following the Stryker's Manufacturing Guidelines. The techniques have been approved and established through the manufacturers. With the approval of this agreement, The West Memphis Fire will approve to pay 0% deposit of the above charges and the remaining 100% at the conclusion and examination of all units. At the conclusion r of each unit, the payment is expected on that unit in full on a net 15 basis. A 10% penalty will be added in the case of payment being overdue. Payment will be made by check payable to Inst-A-Tech LLC. or direct deposit. EFT INFORMATION IS AVAILABLE UPON WRITTEN REQUEST. Credit/Debit cards are accepted with a 3% surcharge added to the total. The West Memphis Fire. will also provide a bay area for the installation of the unit. The West Memphis Fire is also accountable for the procurement and shipment of the Stryker Power Load System(s). Inst-A- Tech LLC will accept accountability for the damage of the Stryker Power Load System(s) should any damage occur during the fitting portion of the assignment. At NO time will Inst-A-Tech LLC take control/ownership of any West Memphis Fire property or mobile units. SCOPE OF SERVICES 1. Procedures A. Assist in planning procurement of the Stryker Power Load System(s). B. Follow recommended steps required to successfully install the new system(s) and assembling with the setup and implementation process. C. In-Line wiring the units with circuit-fuse protection for each unit. D. Testing each unit to meet manufacture specifications before counting the install complete. 2. Re-Checking installation A. Offer a three (3) month re-check on each unit to make sure the installation continues to meet manufacturer approved guidelines B. Offer a one (1) year (from the date of install) limited warranty on the Installation work of each unit. BENEFITS Inst-A-Tech LLC is able to maintain the installation cost to a minimum, due to the customers providing workspace for the installs. Inst-A-Tech LLC also prides itself in being the only company that provides this on-site provision, as well as warranty and re-checks on their work. Inst-A-Tech LLC can install 4 units per day. The 0% security is to cover any fees, license, and/or costs prior to the installs. All employees of Inst-A-Tech LLC are former or current EMS field EMTs/Paramedics, with extensive comprehension of a wide variety of EMS apparatus and mobile units.
