AN ORDINANCE ESTABLISHING RULES AND REGULATIONS
POR PERSONS AND CORPORATIONS DEALING IN
USED, SECOND HAND PRECIOUS METALS, SCRAP JEWELRY OR GEMS,
DECLARING AN EMERGENCY AND POR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:
SECTION I. Definition:
(A) Second Hand or Used - shall be defined as
any person, business, or corporation who
sells, buys, trades, swaps, or offers for
sale or for purchase an,y item that is used.
(B) Precious Metals, scrap jewelry or gems -
shall be defined as diamonds, rubies, emeralds,
sapphires, pearls, gold, sterling silver,
platinum or an,y other jewelry worn on the
person or trinkets kept in the household for
use.
SECTION II. Any person, firm, or corporation purchasing
~: or otherwise dealing in second hand or used precious metals,
scrap jewelry, or gems, where the said purchase is for resale
in its original form or changed by remounting, melting,
reforming, remolding, or recasting or for resale as scrap or
in bulk, shall be required to register with the Chief o.f Police
of the City of West Memphis, Arkansas.
SECTION III. It shall be unlawful for any person or
corporation engaging in the activity described in Section I of
this Ordinance to sell, exchange, barter, or remove from the
place in which said business is conducted or to change the form
of any of said items by remounting, melting, cutting up or
otherwise changing the form of any of said items for a period
of seventy-two (72) hours from the date of said purchase.
SECTION IV. No dealer in second hand scrap jewelry,
precious metals, or gems shall purchase or otherwise receive
from any minor under the age of eighteen (18) ,years, any
property without the written consent of such parent or guardian.

SECTION V. Every person or corporation dealing in
second hand or used scrap jewelry, precious metals, or gems,
or any item described in ,SECTION I of this Ordinance shall
keep a log in duplicate of sales made each day. The Seller
and the Purchaser shall sign the log below the description
of each transaction and shall deliver to the Chief of Police,
City of West Memphis, the log concerning each day's
transactions by noon of the da,y following the date of said
transactions. Such log shall at all times be open for
inspection by the Chief of Police.
SECTION VI. ~;ver,y person or corporation dealing in
second hand or used scrap .jewelry, precious metals or gems
or any item described in SECTION I of this Ordinance at the
time of buying or receiving same shall write a description of
the article on a 3 x 5 card which shall also include:
(1) Seller's Name
(2) Seller's Address
(3) Seller's Date of Birth
(4) Seller's Age
(5) Seller's Place of Employment
(6) Signed Statement of Ownership
(7) Home and Business Phone
(8) Seller's Driver's License or
Social Security Number
(9) Thumb print - if the thumb is not in existence,
then, such other finger print as designated
by the second hand dealer.
SECTION VII. All Ordinances or Parts of Ordinances
in conflict with this Ordinances are hereby repealed.
SECTION VIII. Every person, firm, or corporation, their
agents or employees, who shall violate any of the provisions of
this Ordinance shall on conviction thereof be deemed guilty
of a Class "A" Misdemeanor, which is a fine not exceeding
$1,000.00 or one (1) year in ,jail, or both, at the discretion
of the Court.

SECTION IX. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that
there is an urgent need in the City of West Memphis to
establish some control over persons or corporations dealing
in scrap jewelry, precious metals or gems, an emergency is
hereby declared to exist and this Ordinance being necessary
for the preservation of the public peace, safety, and welfare
of the citizens of West ~Zemphis, Arkansas, shall be in effect
immediately upon its passage and approval.
