ORDINANCE N0. 1066
AN ORDINANCE AUTHORIZING THE CITY OF WEST MEMPHIS,
ARKANSAS, TO LEVY THREE DOLLARS ($3.00) ON EACH
FELONY, 141ISDEMEANOR, AND TRAFFIC VIOLATION OFFENSE
HEARD IN THE WEST MEMPHIS MUNICIPAL COURT; TO
~ USE SUCH FUNDS TO REIMBURSE THE COUNTY FOR
INCARCERATING CITY PRISONERS: DECLARING
AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Act No. 942 of 1981, the 73rd General Assembly
of the State of Arkansas, authorized municipalities to levy an
additional Court Cost not to exceed Three Dollars ($3.00) on
certain offenses and crimes in order to reimburse Counties for
incarcerating City prisoners; and,
WHEREAS, the City of West Memphis needs additional funds
to reimburse the County for this purpose;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. There is hereby levied and collected from each
Defendant, upon each plea of guilty, nolo contendere, forfeiture
of bond or determination of guilt for misdemeanors or traffic
violations heard in the West Memphis Municipal Court, a sum of
Three Dollars ($3.00). The Three Dollars ($3.00) charge will be
in addition to all other costs now or as may hereafter be provided
by law.
SECTION 2. The moneys collected by the levy of the additional
Court Costs shall be deposited in the City Treasury to the credit
of the fund to be known as the CRIMINAL JUSTICE FUND, and such
moneys shall be used solely for reimbursing the County for
expenses incurred in incarcerating City prisoners.
SECTION 3. All Ordinances or parts of Ordinances in .
conflict herewith are hereby repealed.

SECTION 4. Emergency Clause. It having been fund and
determined by the Cit-y~ -Council of the City of West Pdemphis that
there is an immediate need to reimburse the County for incarcerating
City prisoners, an emergency is hereby declared to exist, and this
Ordinance being necessary for the preservation of the peace, safety,
health and welfare of the Citizens of West Memphis, Arkansas, shall
become effective upon its passage a d approval.
