ORDINANCE N0. 1068
AN ORDINANCE TO ABOLISH THE WEST MEMPHIS UTILITY COMMISSION,
REPEALING ORDINANCE N0. 915, DATED, AUGUST 25, 1977,
AND ALL AMENDMENTS THERETO ESTABLISHING A COMMISSION,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,
ARKANSAS:
SECTION 1. Repeal. Ordinance No. 915, dated, August 25, 1977,
establishing a West Memphis Utility Commission and Amendments
thereto, Ordinance No. 964 and Ordinance No. 1050, are hereby
repealed, it being the intent of this Ordinance to abolish the
West Memphis Utility Commission.
SECTION 2. The control, management, and operation of the
West Memphis Utility Department is hereby placed under the super-
vision of the Mayor and the City Council.
SECTION 3. Nothing in this Ordinance shall amend, modify or

repeal any of the legal obligations and bonded indebtedness of
the present West Memphis Utility Commission.
SECTION 4. All Ordinances or Parts of Ordinances in conflict
herewith are hereby repealed.
SECTION 5. Emergency Clause. It having been found and
determined by the City Council of the City of West Memphis, Arkansas,
that Ordinance No. 915 be repealed, an emergency is hereby declared
to exist, and this Ordinance being necessary to protect the peace,
safety, health and welfare of the Citizens of the City of West
Memphis, shall become effective immediately upon its passage
and approval.
