AN ORDINANCE TO AMEND ORDINANCE N0. 1069,
DATED, MAY 21, 1981, .AUTHORIZING THE
UTILITY COMMISSION TO RECOMMEND A GENERAL
MANAGER TO THE MAYOR, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:
SECTION 1. Section 13 of Ordinance No. 1069, dated
May 21, 1981, is amended as follows:
"The Utility Commission shall have the authority
to recommend to the Mayor a General Manager. who
shall be appointed and removed by .the Mayor,
subject to the authority of the City Council to
override the Mayor's decision by two-thirds (2/3)
majority of the total membership elected to the
City Council."
SECTION 2. All Ordinances or Parts of Ordinances in
conflict herewith are hereby repealed.
SECTION 3. Emergency Clause. It having. been found
and determined by the City Council of the City of West Memphis,
Arkansas, that since the Original West Memphis Utility .Ordinance
was enacted, May 21, 1981, Public Law No. 795 of the Arkansas
General Assembly which became effective June 17,.1981, changed
Section 13 of Ordinance No. 1069 in the procedure to appoint
a General Manager, therefore, an emergency is declared to exist,
and this Ordinance being necessary for the preservation of the
public peace, safety, health and welfare of the citizens of the
City of West Memphis, Arkansas, shall be in full force and
effect from the date of its passage and approval.
