AN ORDINANCE TO AMEND SECTION 3.04.060 OF THE WEST
MEMPHIS MUNICIPAL CODE REGARDING RESIDENCY OF
CERTAIN MEMBERS OF THE ADVERTISING AND PROMOTION
COMMISSION,AND FOR OTHER PURPOSES.
WHEREAS, Section 3.04.060 of the West Memphis Municipal Code currently requires
that all seven members of the West Memphis Advertising and Promotion Commission must be
residents of the City of West Memphis; and
WHEREAS, the state statutes regarding Advertising and Promotion Commissions,
specifically A.C.A. §26-75-605, permit the municipality to adopt an ordinance to permit the four
members who are owners or managers of businesses in the tourism industry to reside outside of
the municipality but within the county where the municipality is located; and
WHEREAS, A.C.A. §26-75-605 also permits the one member of the Advertising and
Promotion Commission representing the public at large to reside within the municipality or in the
county of the municipality; and
WHEREAS,the West Memphis Advertising and Promotion Commission has
recommended that the West Memphis Municipal Code be amended to be consistent with current
state statutes regarding the residency of its members; and
WHEREAS, it is the specific intent of this ordinance to provide that the four(4)
members of the West Memphis Advertising and Promotion Commission representing the tourism
industry and the one (1) member representing the public at large may reside outside of the City of
West Memphis, but within Crittenden County, Arkansas;
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS, THAT:
SECTION 1. Section 3.04.060(A) of the West Memphis Municipal Code is hereby
amended to read as follows:
There is created under the provisions of A.C.A. §26-75-605, a city advertising and
promotion commission to be composed of seven(7) members, as follows:
1. Four(4) members shall be owners or managers of businesses in the tourism
industry, and the owner or manager shall reside within the City of West Memphis,
or may reside outside the City of West Memphis but within Crittenden County,
Arkansas. At least three (3) of these members shall be owners or managers of
hotels, motels, or restaurants. These members shall serve for staggered terms of
four (4) years.
2. Two (2) members of the commission shall be members of the City Council of the
City of West Memphis and selected by the City Council and shall serve at the will
of the City Council.
3. One (1)member shall be from the public at large who shall reside within the City
of West Memphis or within Crittenden County, Arkansas, and shall serve a term
of four (4)years.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of any such conflict.
