AN ORDINANCE TO AMEND ORDINANCE N0. 715
OF THE CITY OF WEST MEMPHIS, ARKANSAS;
TO EXCLUDE SIGN AND COMMERCIAL ADVERTISING
WITHIN CERTAIN AREAS OF THE CITY LIMITS OF
WEST MEMPHIS, ARKANSAS, DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,
ARKANSAS:
Section 1. Section 8-2 of Ordinance No. 715 of the City of
West Memphis, Arkansas, is hereby amended to exclude sign advertising,
commercial, and as a permitted use in the B-2 and M-2 Zoning Districts
of the City of West Memphis, Arkansas.
Section 2. Section 9.2121 of Ordinance No. 715 is repealed.
Section 3. It is the intention of this ordinance to prohibit
future construction within the City Limits of the City of West
Memphis, Arkansas, sign advertising as defined in Section 15 of
Ordinance No. 715 of the City of West Memphis, Arkansas. It is not
the intention of this ordinance to prohibit sign advertising on a
lot which directs attention to a commodity, service, or entertainment
that is sold on the lot on which a business is located.
Section ~. Penalty. Any person, firm, association, or
corporation found guilty of violating any of the provisions of this
ordinance shall be subject to a fine in the amount of not less than
Fifteen and No/100ths Dollars ($15.00) nor more than Twenty-Five
and No/100ths Dollars ($25.00), and each day such violation exists
shall constitute a separate offense.
Section 5. Emergency Clause. It being found and determined
by the City Council of the City of West Memphis, Arkansas that
there is an immediate need for this ordinance for the City of
West Memphis, Arkansas, an emergency is hereby declared to exist
and this ordinance shall be in full force and effect from and after
its passage and approval.
