AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF
FOUR HUNDRED AND TWENTY-FIVE 9QGALLON SANITATION CARTS,
DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, Resolution No. 1653, passed on the 6~' day of July, 2000, allowed the Public
Works Director to implement a 90-day Pilot Curbside Garbage Pick-up Program; and
WHEREAS, Resolution No. 1653 also allowed the Public Works Director to enter into a
lease agreement with Scruggs Equipment Company in Memphis, Tennessee, to lease four
hundred and twenty-five 90-gallon curbside carts for the agreed upon 90-test period at a cost not
to exceed $2.75 per cart per 30-day period, at a total estimated cost not to exceed approximately
$3,600.00; and
WHEREAS, Resolution No. 1653 provides that at the end of the 90-day test period, the
City would be allowed to either purchase said carts for about $50 each or have them steam
cleaned, unassembled, and pay the shipping to return them to the supplier; and
WHEREAS, Resolution No 1653 states that prior to the end of the 90-day test period, the
Public Works Committee would evaluate the results of the program and present a
recommendation to the City Council as to whether or not to continue the Curbside Garbage Pick-
up Program on the pilot route; and
WHERAS, it is the desire of the Public Works Committee to continue the Curbside
Garbage Pick-up Program in the pilot area and establish it as a permanent service;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived and Scruggs Equipment Company be paid
$23,413.20, which includes the total rent due on the carts, for the purchase of four
hundred and twenty-five 90-gallon curbside carts
2. EMERGENCY CLAUSE: It having been found and determined by the City
Council of the City of West Memphis, Arkansas, that there is an urgent need to
complete this purchase as soon as possible so that Scruggs Equipment Company
does not have to wait 30 days before their invoice can be processed and so the
City can maintain a good working business relationship with Scruggs Equipment
Company, an emergency is hereby declared to exist, and this Ordinance being
necessary for the preservation of the public peace, health, safety, and welfare of
the citizens of West Memphis, Arkansas, shall be in full force and effect from
and after the date of its passage and approval.

RESOLUTION APPROVING THE RECOMMENDATIONS OF THE PUBLIC WORKS
COMMITTEE TO IMPLEMENT A PILOT CURBSIDE GARBAGE PICK-UP PROGRAM
WHEREAS, the Public Works Committee of the City of West Memphis has voted
unanimously to implement a pilot curbside garbage pick-up program; and
WHEREAS, it is the desire of the Committee to target approximately 400 homes
in the northeast section of the City for a trial period of 90 days; and
WHEREAS, the Committee recommends that the Public Works Director be
allowed to enter into a lease agreement with Scruggs Equipment Company in Memphis,
Tennessee, to lease four hundred and twenty-five 90-gallon curbside carts for the
agreed upon 90-day trial period; and
WHEREAS, the price the City will pay to lease said carts shall not exceed $2.75
per cart per 30-day period, at a total estimated cost not to exceed approximately
$3,600.00; and
WHEREAS, after the 90-day test period ends, the City will have the option of
either purchasing the carts for about $50 each or having them steam cleaned,
unassembled, and paying the shipping to return them to the supplier; and

OF WEST MEMPHIS, ARKANSAS, that the recommendations of the Public Works
Committee be accepted and that the Public Works Director immediately begin
implementing the recommendations fora 90-day Pilot Curbside Garbage Pick-up
Program.
