BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST

MEMPHIS, ARKANSAS:
SECTION I. Section 12:11 of Ordinance rdo. 715, dated
March 16, 1972, is amended to read as follows:
"It shall be unlawful to commence the construction or the
excavation for the construction of any building or structure,
including accessory building, or to commence the moving or
alteration of any building, including accessory building
within the territorial jurisdiction of this Code until the
Building Inspector rias issued a building permit for such work.
The Building Inspector shall not issue a permit until he has
ascertained that such construction is in full compliance ~~~ith
all the provisions of tl~.e Zoning Ordinance and all other applicable
ordinances of the City of West Memphis, including, but not
~` limited to the Building Code and Subdivision Code.
With restiect to any area within the jurisdiction of this Code
but outside the City Limits of West Memphis, the granting or
denial of a building permit shall be based on the terms of the
Zoning Ordinance and Subdivision Code, and not on the Building
Code of the City except for fees and expiration date. Except
upon written authorization of the Board of Adjustment as provided
in Section 11 and subsection 12.4 no such building permit shall
be issued for any building where said construction, moving,
alteration, or use thereof would be in violation of any provisions
of the City codes."
SECTION II. Subparagraph Three (3) of Section 12.12 of
Ordinance No. 715, dated March 16, 1972, is amended to read as
follows:
"(3) Where the zoning lot consists entirely of one (1)
unplatted parcel containing five (5) acres or more, the zoning
lot shall be shown by a survey made by a person authorized to
make land surveys in the State of Arkansas."

SECTION III
Section 12.12 0~ Ordinance No. 715, dated
March 16, 1972, is further amended by adding subparagraph..
Four (4) to read as follows
(4) Where the zoning lot consists of a portion of
one (1) or more unplatted parcels and contains less than
`~ five (5) acres, the zoning lot shall be shown as a single.
entire lot in a new recorded plat that has been submitted
and approved by the Planning Commission of the City o,f ~rTest
Memphis, Arkansas, or approved by a designated agent a£ the.
Planning Commission. Said designated agent shall b can
administrative officer of the City which. by appointment
the Planning Commission empowers to approve by endorsement,
on behalf of the Planning Commission, such single lot plats
from unplatted parcels that meet all of the applicable
requirements in the Zoning and Subdivision Codes. Plat
requirements including required information, information to
be shwon on the Plat, referral and reporting to the. Planning
Commission shall be the same as that set forth for Lot~Split
Plats in the Subdivision Codes.
