AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS
AND REFURBISHING OF THE ELEVATOR AT THE WEST MEMPHIS
UTILITY COMMISSION BUILDING, DECLARING AN EMERGENCY,
AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible
or practical; and
WHEREAS, the City of West Memphis is in need of repairing and refurbishing the
elevator at the West Memphis Utility Commission building; and
WHEREAS,this elevator provides the only automated entrance to the second floor at the
West Memphis Utility building and proper maintenance of the elevator is necessary to continue
to provide such access and to maintain compliance with the Americans with Disabilities Act; and
WHEREAS, ThyssenKrupp Elevator(TKE)Americas has been responsible for
inspecting and maintaining this elevator for many years; and
WHEREAS, after the most recent annual inspection of the elevator it was determined
that it was in need of repairs and that some key replacement elements were no longer made or
available for the elevator; and
WHEREAS, TKE is uniquely experienced in providing maintenance and repairs for this
elevator and having one contractor responsible for the maintenance and repairs of the elevator
will maintain the continuity of the maintenance and repair records and assure accountability for
necessary repairs; and
WHEREAS, TKE has identified the necessary repairs in the scope of work attached
hereto which can be made at a cost of$64,950.00 plus applicable sales taxes;
WHEREAS,the City Council determines that competitive bidding should be waived for
the reason that the services of repairing and refurbishing the elevator at the West Memphis
Utility building are of such a specific nature and that it would not be practical to have multiple
contractors responsible for such services and competitive bidding under such circumstances
would not be feasible or practical;
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for repairing and refurbishing the
elevator at the West Memphis Utility Commission building, for a total cost of$64,950.00 plus
applicable taxes as set out in the attached scope of work. These services to be provided by
ThyssenKrupp Elevator(TKE) Americas.
SECTION 2. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas,that an urgent and immediate need exists
to repair and refurbish the elevator at the West Memphis Utility building in order to continue to
provide proper access to the second floor of the building and to maintain compliance with the
Americans with Disabilities Act, an emergency is hereby declared, and this ordinance being
necessary for the preservation of the peace,health, safety and welfare of the citizens of West
Memphis, Arkansas, shall be in full force and effect from and after the date of its passage and
approval.
SECTION 3. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.

Mayor William Johnson&West Memphis City Council Members;
I am presenting a request that ThyssenKrupp Elevator(TKE) Americas be given permission to
refurbish our elevator for$ 64,950.00 plus all related sales tax. This request will include giving
the Mayor permission to sign the contract with a payment of 50%($ 32,475.00) included with
the signed agreement. I also request that you (City Council)approve the waving of competitive
bidding, the ordinance read out three times and grant the emergency clause.
History:
The elevator located at the West Memphis Utility Commission building at 604 E. Cooper
was installed in the building when it was built(finished in 1975). TKE has repaired and
maintained the elevator since before I was elected City Treasurer in 1999.
Currently:
TKE inspects and maintains our elevator annually and has addressed all issues that the
inspectors with the State of Arkansas,Department of Labor, Elevator Safety Division has
requested be addressed on their annual inspections.
On TKE's annual inspection this year,the maintenance person voiced concern that some
key replacement elements were no longer made or even available for our elevator. At that time
we scheduled a full inspection and I requested a quote,including a scope of work (S O W) for
the upgrades.
This is the only automated entrance to the second floor, there are two flights of stairs.
Reason:
Considering the history and current status,I feel this represents justification asking for
the waving of competitive bidding and reading out the Ordinance and granting the emergency
clause approving this upgrade by TKE.
