AN ORDINANCE TO AMEND PARAGRAPH 2 OF
SECTION 2, OF ORDINANCE NO. 381 OF THE CITY
OF WEST MEMPHIS, ARKANSAS: DECLARING_AN
EMERGENCY AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS.

Section 1. Paragraph 2 of Section 2 of Ordinance No. 381 of
the City of West Memphis, Arkansas is hereby amended to read as :follows.
"The Board of Utility Commissioners shall qualify and take the
oath of office within thirty days after their appointment, a.nd i.n the event
any person appointed as such Commissioner shall fail to qualify within
thirty days of his appoi.ntme.nt, or if a.ny person appointed as Commissioner
moves outside the city limits of the City of West Memphis, his office shall
be vacant and his successor shall be appointed by the City Council. In the
event of a vacancy caused by death, removal or otherwise, a successor shall
be appointed by the City Council to fill out the unexpired term. "
Section 2. All ordi.na.nces or parts of ordinances in conflict
herewith a.nd specifically Paragraph 2 o:f Sectio.n 2 of Ordi.na.nce 381 of the
City of West Memphis is hereby repealed and all ordi.na.nces or parts of
ordinances .not i.n convlict herewith shall remain in full force a.nd effect.
Section 3. It is found a.nd determined by the City Council
of the City of West Memphis, Arkansas, that this ordinance is immediately
.necessary :for the health, safety a.nd well-being of the citizens o:f West
Memphis; therefore an emergency is declared to exist and this ordinance
shall be in full force a.nd effect from a.nd after its passage and approval
as required by law.
