AN ORDINANCE IN PURSUANCE OF THE AUTHORITY GRANTED BY
THE LEGISLATURE OF THE STATE OF ARKANSAS IN ACT 186 OF
1957, PROVIDING FOR THE ADOPTION, BY REFERENCE, OF A CODE
OF ZONING REGULATIONS FOR THE CITY OF WEST MEMPHIS,
ARKANSAS; REPEALING ORDINANCE N0. 411 OF 1961 AND ALL
OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH
TO THE EXTENT OF SUCH CONFLICT; PROVIDING PENALTY FOR VIOLATION
OF SAID CODE; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
Section 1. There is hereby adopted by the City Council of the City of West
Memphis, Arkansas, pursuant to Act 186 of the 1957 Acts of Arkansas, a Code of
Zoning Regulations which is entitled:
"ZONING CODE FOR THE CITY OF WEST MEMPHIS, ARKANSAS. A CODE IN
PURSUANCE OF THE AUTHORITY GRANTED BY THE LEGISLATURE OF THE STATE
OF ARKANSAS IN ACT 186 OF 1957,ESTABLISHING ZONING REGULATIONS AND
AND DISTRICTS IN ACCORDANCE WITH A LAND USE PLAN; REGULATING THE
LOCATION, HEIGHT, BULK, NUMBER OF STORIES AND SIZE OF BUILDINGS:,
REGULATING OPEN SPACES, LOT COVERAGE, DENSITY OF POPULATION;
REGULATING THE USES OF LAND, BUILDINGS AND STRUCTURES WITHIN THE
CITY OF WEST MEMPHIS; DIVIDING SAID AREAS OF THE CITY OF WEST MEMPHIS
INTO DISTRICTS AND ZONES; REGULATING THE ERECTION, CONSTRUCTION,
RECONSTRUCTION, CONVERSION, ALTERATION OF BUILDINGS AND STRUCTURES;
PROVIDING FOR UNIFORM REGULATIONS FOR EACH CLASS OR KIND OF BUILDING
THROUGHOUT EACH DISTRICT; AND PROVIDING FOR A BOARD OF ADJUSTMENT."
Section 2. Ordinance No. 411 of the City of West Memphis, Arkansas and all
other ordinances or parts of ordinances in conflict herewith to the extent of such conflict
are hereby repealed.
Section 3. Any person, firm or corporation who shall violate any of the provisions
of this Code or fail to comply substantially therewith, or who shall violate or fail to comply
substantially with any order or regulation made thereunder, or who shall build in violation
of any detailed statement of specification or plans submitted and approved thereunder,
or any certificate or permit issued thereunder, shall be guilty of a misdemeanor and upon
conviction thereof shall be fined not more than $25.00 for any one specified offense or

violation of this ordinance, or double that sum for each repetition of such offense
or violation of this ordinance
. If a thing prohibited or rendered unlawful is in its nature continuous in
respect to time, the fine or penalty for allowing the continuance thereof, in violation of
this Code, shall not exceed $15.00 for each day that the same may be unlawfully continued.
Section 4. It shall be the duty of the Building Inspector to see that this
Code is enforced.
Section 5. It being found and determined by the City Council of the City of
West Memphis, Arkansas, that the present zoning code and regulations heretofore existing
are in immediate need of modification and change in the interest of the orderly growth
and expansion and the health,safety and welfare of the City of West Memphis, an
emergency is hereby declared to exist and this Ordinance shall be in full force and effect
from and after its passage and approval as required by law.
