AN ORDINANCE IN PURSUANCE OF THE AUTHORITY GRANTED BY THE
LEGISLATURE OF THE STATE OF ARKANSAS IN ACT 186 OF 1957,
PROVIDING FOR THE ADOPTION, BY REFERENCE, OF A CODE OF
SUBDIVISION REGULATIONS FOR THE CITY OF WEST MEMPHIS,
ARKANSAS; REPEALING ORDINANCE N0. 412 OF 1961 AND ALL OTHER
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO
THE EXTENT OF SUCH CONFLICT;PROVIDING PENALTY FOR VIOLATION
OF SAID CODER DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,
ARKANSAS:
Section 1. There is hereby adopted by the City Council of the City of West Memphis,
Arkansas, pursuant to Act 186 of the 1957 Acts of Arkansas, a Code of Subdivision
Regulations which is entitled:
"SUBDIVISION CODE FOR THE CITY OF WEST MEMPHIS, ARKANSAS.
A CODE ESTABLISHING REGULATIONS FOR THE SUBDIVIDING AND
PLATTING OF LAND: PROVIDING FOR SUBMITTING PLATS FOR
APPROVAL: DESCRIBING PROCEDURES: SETTING FORTH PLAT
REQUIREMENTS AND FEES FOR APPROVAL, SUBDIVISION DESIGN
STANDARDS, AND IMPROVEMENT REQUIREMENTS.
Section 2. Ordinance No. 412 of the City of West Memphis, Arkansas and all
other ordinances or parts of ordinances in conflict herewith to the extent of such conflict
are hereby repealed.
Section 3. Any Person, firm or corporation who shall violate any of the provisions
of this code or fail to comply substantially therewith or who shall violate of fail to comply
substantially with any order or regulation made thereunder, or who shall build in violation
of any detailed statement of specification or plans submitted and approved thereunder, or any
certificate or permit issued thereunder, shall be guilty of a misdemeanor and upon conviction
thereof shall be fined not more than $25.00 for any one specified offense or violation of this
ordinance, or double that sum for each repetition of such offense or violation. If a thing
prohibited or rendered unlawful is in its nature continuous in respect to time, the fine or
penalty for allowing the continuance thereof, in violation of this code, shall not exceed
$15.00 for each day that the same may be unlawfully continued.

Section 4. It shall be the duty of the ~a~di:~as~~~xto see that this Code is
enforced.

Section 5. It being found and determined by the City Council of the City of West
Memphis, Arkansas, that the present subdivision code and regulations heretofore existing
are in immediate need of modification and change in the interest of the orderly growth and
expansion and the health, safety and welfare of the City of West Memphis, and emergency is
hereby declared to exist and this Ordinance shall be in full force and effect from and after its
passage and approval as required by law.
