A RESOLUTION CERTIFYING THE REMOVAL OF LITTER, DEBRIS AND
OTHER ITEMS FROM 2113 EAST BROADWAY AVENUE, LOT 4146, BLOCK
181 OF THE KENDAL SUBDIVISION, WEST MEMPHIS, AR.
WHEREAS, chapter 6.20 and chapter 12.64 of the West Memphis Municipal Code
provides a procedure for the City Council to remove litter, debris and other items from private
property, constituting a nuisance and danger to public health, safety or welfare; and
WHEREAS, as provided by chapter 6.20 and chapter 12.64 of the West Memphis
Municipal Code, notice of the removal of litter, debris and other items from private property
shall be provided by mailing a certified copy of the resolution to the owner or owners if their
whereabouts are known, or to their last known address, giving ten (10) days notice to clean the
property; and
WHEREAS, as provided in chapter 6.20 and chapter 12.64 of the West Memphis
Municipal Code, the litter, debris, and other items may be removed by the building inspector or a
duly designated representative if the problem has not been abated within ten (10) days after
proper notification to the property owner or owners; and
WHEREAS, if the city has any net costs in removal of any litter, debris and other items,
the city shall have a lien placed on the property
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT, the property located at 2113 East
Broadway Avenue, Lot 41-46, Block 181 of the Kendal Subdivision, West Memphis, AR, is
hereby declared to be a nuisance and danger to public health, safety or welfare for depositing
litter, debris and other items in a prohibited manner.
BE IT FURTHER RESOLVED, THAT, if the items causing a nuisance and danger to
public health, safety or welfare have not been removed or otherwise abated within ten (10) days
of proper notification to the property owner, Edward Saig dba The Saig Co., by certified mail,
the building inspector or his duly designated representative is authorized and directed to remove
the litter, debris and other items constituting a nuisance and danger to public health, safety or
welfare and to cause a lien to be placed on 2113 East Broadway Avenue, Lot 41-46, Block 181
of the Kendal Subdivision, West Memphis, AR, for any net costs incurred by the city for the
removal of said items.
