AN ORDINANCE APPROVING RELOCATION OF ELECTRICAL
TRANSMISSION LINE OF ARKANSAS POWER & LIGHT
COMPANY AND AUTHORIZING IT TO CROSS DEDICATED
STREETS, ALLEYS AND WA YS TO BE OCCUPIED BY SAID
.,~,„ RELOCATION, and FOR OTHER PURPOSES AND DECLARING
AN EMERGENCY.
WHEREAS, Arkansas Power & Light Company is the owner of a
right of way for a transmission line constructed about 1927 across the
N2 SZ of Section 1, Township 6 North, Range 8 East; and
WHEREAS, in order that the lands across which the present trans-
mission line runs may be fully and orderly developed by the owner thereof,
Arkansas Power & Light Company has agreed, upon certain terms and con-
ditions among which is the adoption of this ordinance, to relocate the trans-
mission line as follows:
Beginning in the southeasterly part of the N~ SZ
of Section 1, Township 6 North, Range 8 East, on
} the center line of the existing transmission line at
a point which is 39 feet, more or less, north of the
south line of said NZ S2 and 159 feet, more or less,
Y... east of the southwest corner of Lot 1, Avondale
Commercial Subdivision; thence westerly 491 feet,
more or less, to a point which is 75 feet north of
the south line of said NZ SZ and 12 feet, more or
less, east of the west line of Lot 2 of Avondale
Commercial Subdivision; thence west parallel to the
south line of said NZ Sz 2, 822 feet, more or less;
thence northerly 1, 222 feet, more or less, to
termination at the point of intersection with the
center line of the existing transmission line,
and
WHEREAS, said transmission line as relocated will cross the same
streets and ways as the present transmission line, except it will no longer
cross Shoppingway Street, and it is necessary that the City of West Memphis
approve the relocation of said line and authorize Arkansas Power & Light
Company to cross dedicated streets, alleys and ways to be occupied by said
relocation; and
WHEREAS, the City of West Memphis has determined that it would
greatly benefit the city to have the transmission line relocated as proposed
so that the area where the line is presently located may be more orderly
developed; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
N!E MPHIS:
SECTION I
That the proposed relocation of the electrical transmission line of
Arkansas Power & Light Company be, and the same is hereby, approved,
and that Arkansas Power & Light Company be, and it is hereby authorized
and permitted to cross dedicated streets, alleys and ways to be occupied by
said proposed relocation along the following line:
Beginning in the southeasterly part of the NZ S2
of Section 1, Township 6 North, Range 8 East, on
the center line of the existing transmission line at
a point which is 39 feet, more or less, north of the
south line of said NZ S2 and 159 feet, more or less,
east of the southwest corner of Lot 1, Avondale
Commercial Subdivision; thence westerly 491 feet,
more or less, to a point which is 75 feet north of
the south line of said N2 SZ and 12 feet, more or
less, east of the west line of Lot 2 of Avondale
Commercial Subdivision; thence west parallel to the
south line of said NZ S2, 2, 822 feet, more or less;
thence northerly 1, 222 feet, more or less, to
termination at the point of intersection with the
center line of the existing transmission line.
SECTION II:
That all ordinances and parts of ordinances in conflict herewith be,
and the same are, hereby repealed.
SECTION III:
It is hereby ascertained and declared to be a fact that the property
across which said transmission line now runs is in the process of develop-
ment and that the passage of this ordinance is in the interest of the growth
and orderly development of the City of West Memphis, and of the public
peace, health, safety and welfare of the citizens of West Memphis, and
an emergency is hereby declared to exist and this ordinance shall be in
full force and effect from and after its passage and approval.
