ORDINANCE N0. ~~~
AN ORDINANCE TO AMEND ORDINANCE N0. 716 DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF WEST MEMPHIS, ARKANSAS
Section 1. Ordinance No. 716 of the City of West Memphis,

~+• Arkansas, is amended as follows:
Page 3. Paragraph 2.12 Pre-Application Conference, is hereby
inserted after Paragraph 2.11 and before Paragraph 2.121. Said
Paragraph 2.12 reads as follows :
Prior to the filing of a preliminary plat, the developer shall meet
with the City Engineer to familiarize himself with the Citys
development regulations and the relationship of the proposed subdivision
to the Comprehensive Plan for the City. At such meeting, the general
character of the development will be discussed, and items will be
included concerning zoning, utility service, street requirements
a.nd other pertinent factors related to the proposed subdivision. At
the Pre-Application Conference the developer may be represented by his
engineer or other authorized representative.
Page 5. Paragraph 2.126 Distribution, is hereby amended to
read Paragraph 2.126 City Council Action. Said Paragraph 2.126
City Council Action, reads as follows:
After conditional approval of the Sketch Plat by the Planning
Commission, the City Engineer shall present such Plat at the
`r- following City Council meeting for the Council's conditional
approval. When the City Council approves such plat, it shall
conditionally approve such Plat by placing a stamp of Sketch
Plat Approval upon the Plat. The City Council's stamp of Sketch
Plat Approval shall read: "This plat has been given City Council's
preliminary plat approval only and shall not constitute the acceptance
by the public of the dedication of any streets or other public
way or ground, and has not been approved for recording as a public
record".
Two copies of the conditionally approved Sketch Plat shall be filed
in the office of the City Engineer, and one copy shall be conveyed
to the subdivider.
page 5. paragraph 2.127 Authorization to Prepare Final Plat,
is hereby amended by inserting the words "and City Council" after
the word Commission.
Page 7. paragraph 2.135 Final Plat Approval for Portion of
Subdivision, is hereby amended to read:
A developer at his option, may obtain a'pprova'l of a portion or a
section of a subdivision provided he meets all the requirements of
this Ordinance with reference to such portion or section in the
same manner as is required for a complete subdivision. In the
' event that a subdivision and the Final Plat thereof are approved
~,,,,. in sections by the Commission, such Final Plat of each section -
shall carry the name of the entire subdivision, but shall bear a.
distinguishing letter, number or subtitle. Block numbers shall
run consecutively throughout the entire subdivision, even though
such subdivision may be finally approved in sections.

When the proposed subdivision constitutes a unit of a larger tract
owned by the developer which is intended to be subsequently
subdivided as additional units of the same subdivision, the preliminary
and final plats shall be accompanied by a layout of the entire
area, showing the tentatively proposed layout of streets, blocks,
drainage, water, sewer a.nd other improvements for such areas, the
overall layout, if approved by the Commission and City Council, shall
be attached to and filed with a copy of the approved subdivision
plat in the permanent files of the City Engineer. Thereafter,
plats of subsequent units of such subdivision shall conform to such
approved overall layout, unless changed by the Commission. However,
except where the developer agrees to such than ge, the Commission
may change such approved overall layout only when the Commission
finds :
a. That adherence to the previously approved overall
layout will hinder the orderly subdivision of other
land in the area in accordance with the provisions
of the West Memphis Comprehensive Plan.
b. That adherence to the previously approved overall
layout will be detrimental to the public health,
safety or welfare, or will be injurious to other
property in the area..
Page 13. Item Number 5 of Required Information, Paragraph
3.13, is hereby amended to read ". ... drawn to a scale of one inch
equals 50 feet horizontal and one inch equals five feet vertical,...".
Page 15. Item Numbers 10 and 11 of Required Information,
Paragraph 3.13, is hereby amended to read "..... scale of one inch
equals 100 feet or larger".
Page 16. Paragraph 4.22 Street Alignment, is hereby amended
to read as follows: "The radii of curvature shall not be less than
1400 feet on the centerline of major thoroughfares, 400 feet for
collector streets, and 150 feet for local streets.
Page 17. Paragraph 4.231 Angle of Intersection, is hereby
amended by replacing sixty (60) degrees with seventy-five (75)
degrees .
Page 22. Paragraph 5.l General, is hereby amended by deleting
the words "street signs" from the first sentence and adding the
following sentence at the end of the first pa'ra'graph: "Street
signs shall be installed by the City at the developers expense".
Page 22. Paragraph 5.2 Street Improvements in Residential
Sections, is hereby amended by deleting the words "in Residential
Sections" from the paragraph title.
Page 24. Paragraph 5.21 (c) Curb Radii, is hereby amended by
inserting 30 feet in place of 20 feet in sentence C (1) and 25 feet
in place of 20 feet in sentence C (3).
Page 25. Paragraph 5.21, is hereby amended by forming a new
section 5.21 (F) by the insertion of the letter "F" before the sentence
reading "Detailed plans, specifications,.....".
Page 26. Paragraph 5.51 General, is hereby amended by inserting
the following after the first sentence: "All drainage facilities
shall be so designed to serve the entire drainage area.".

Section 2. All other provisions or Ordinance No. 716 of the
City of West Memphis shall remain in full force and effect except
as herein specif ically amended.
Section 3. EMERGENCY CLAUSE. It is hereby found and declared
....
by the City Council that this Ordinance is immediately needed for
the proper functioning of the West Memphis Comprehensive Plan. That
the original West Memphis Comprehensive Plan needs certain modification
and changes; therefore, an emergency is declared to exist and this
Ordinance being necessary for the preservation of the public peace,
health, and safety, shall take effect and be in full force from
and after the date of its passage and approval as required by law.
