AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR
"..PLAYGROUND EQUIPMENT AND PLAYGROUND IMPROVEMENTS
AT MATTHEWS PARK,HICKS PARK AND WORTHINGTON PARK,
AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible
or practical; and
WHEREAS,'the City of West Memphis and the West Memphis Parks and Recreation
Department are in need of purchasing new playground equipment and making playground
improvements at Matthews Park, Hicks Park and Worthington Park; and
WHEREAS, the City Council determines that competitive bidding should be waived for
the reason that Wilco Services, L.L.C., was the only company that bid on the prior two
playground improvement projects. The projects were completed. The work was satisfactory and
this would allow the project to be completed for the spring recreation season and competitive
bidding under such circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for playground equipment and
playground improvements for the West Memphis Parks and Recreation Department, for a total
cost of$44,000.00. These services are to be provided by Wilco Services, L.L.C.
