ORDINANCE ADOPTING ZONING FOR• ANNEXED
TERRITORY AND AMENDING ZONING DISTRICT MAP
WHEREAS, property owned by J. Craig Tennison, C. H. Bond, Jr.,
~, J. D, Burnett, B. H. Burnett, Kemmons Wilson, James Richard Walker and
Guaranty Loan & Real Estate Company, a corporation, has recently been
annexed to the City of West Memphis and has been accepted by the City as part
of such City; and,
WHEREAS, all of the tract of lands annexed to the City are already
classified upon and included within the zoning district map of the City of West
Memphis with the exception of a parcel of such land owned by Kemmons Wilson
and Guaranty Loan & Real Estate Company, a corporation, which is described
as:
A triangular tract of land lying South of the Missouri Pacific
Railroad right of way, North of the present boundary of the
zoning area of the City of West Memphis (which is on the section
line between Sections Four (4) and Five (5), Township Six (6)
North, Range Nine (9) East and Sections Eight (8) and Nine (9),
Township Six (6) North, Range Nine (9) East) and East of the
center line of Ten Mile Bayou, being that part of the Southeast
Quarter (SE-y) of Section Five (5) lying East of the center line of
Ten Mile Bayou and South of the Missouri Pacific Railroad and
that part of the Southwest Quarter (SW4) of Section Four (4) lying
South of the Missouri Pacific Railroad; and,
WHEREAS, property on the West side of the triangular tract is
presently :outside of the present zoning area of the City of West Memphis and
property on the North side of the tract which is North of the Missouri Pacific
Railroad is also outside of the present zoning area of the City of West Memphis,
and property lying immediately South of the triangular tract is zoned M-1
~~Limited Industrial" and the owners of such tract have requested that the
triangular tract described be classified and zoned as M-1 'Limited Industrial"
and have presented a petition to the Planning Commission of the City of West
Memphis, Arkansas, requesting approval of this zoning classification, and the
Planning Commission of the City of West Memphis has gone on record as ap-
proving the zoning classification requested;
NOW, THEREFORE, be it ordained by the City Council of the City of
West Memphis, Arkansas:
SECTION 1. That territory accepted for annexation to the City of
West Memphis, Arkansas., by Ordinance No. _ f ~ and described as follows,
to-wit:
A triangular tract of land lying South of the Missouri Pacific
Railroad right of way, North of the present boundary of the
zoning area of the City of West Memphis (which is on the section
line between Section Four (4) and Five (5), Township Six (6)
North, Range Nine (9) East and Sections Eight (8) and Nine (9),
Township Six (6) North, Range Nine (9) East) and East of the
center line of Ten Mile Bayou, being that part of the Southeast
Quarter (SE4) of Section Five (5) lying East of the center line of
Ten Mile Bayou and South of the Missouri Pacific Railroad and
that part of the Southwest Quarter (SW4) of Section Four (4) lying
South of the Missouri Pacific Railroad,
be, and the same is hereby zoned as M-1 "Limited Industrial" and that the

zoning district map of the City of West Memphis be, and the same is hereby,
amended to conform to such zoning and to reflect the territory described as
within the zoning area and included upon the zoning district map of the City
of West Memphis.
SECTION 2. That the described territory be henceforth subject
to all provisions of zoning and subdivision ordinances of the City of West
Memphis as they apply to lands classified and zoned as M-1 "Limited In-
dustrial."
SECTION 3. It is hereby found and declared by the City Council
of the City of West Memphis that this ordinance is necessary for the proper
protection and preservation of the City of West Memphis and the integrity of
zoning classifications and ordinances and for the public peace, safety and
welfare of the City and, therefore, . an~i emergency is hereby found and declared
to exist, and this ordinance shall be in full force and effect from and after its
passage, approval and publication as required by law.

TO THE PLANNING COMMISSION OF THE CITY OF WEST MEMPHIS, ARKANSAS
PETITION FOR ZONING OF LANDS
Comes Kemmons Wilson and Guaranty Loan & Real Estate Com-
pany, a corporation, and petition that the Planning Commission ap}xove
zoning of property owned by them which is being annexed to the City
of West Memphis as M-1 Limited Industrial and in support of that Pe-
tition, states:

The property to be zoned is a triangular tract of lands
lying South of the Missouri-Pacific Railroad right-of-way North of
the present zoning area of the City of West Memphis and East of the
center line of Ten Mile Bayou; being that part of the Southeast Quar-
ter (SE 4) of Section Five (5) , Township Six (6) North, Range Nine (9)
East lying East of Ten Mile Bayou and South of the Missouri-Pacific
Railroad and that part of the Southwest Quarter (SW 4) of Section Four
(4), Township Six (6) North, Range Nine (9) East lying South of the
Missouri-Pacific Railroad;

Property lying immediately South of this tract ~.s zoned M-1
Limited Industrial and this zoning appears to be the appropriate zon-
ing for this tract for which annexation to the City of West Memphis
has been approved by the County Court of Crittenden County and which
will immediately be presented to the City Council of the City of West
Memphis for acceptance. A11 other parts of the annexation proposed
for acceptance by the City Council is already subject to zoning by
the most recent zoning ordinances of the City of West Memphis.
WHEREFORE, your Petitioners pray that the Planning Commis-
lion of the City of West Memphis give its approval to the proposed

zoning in order that the property may be properly zoned by the City
Council upon acceptance of these lands within the City limits of the
City of West Memphis.
