AN ORDINANCE TO AMEND ORDINANCE N0. 716,
SUBDIVISION CODE, DECLARING AN EMERGENCY,
AND FOR OTHER PURPOSES

~ BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
Sec ion 1. Section 1 - 1.2 of Ordinance No. 716 is repealed and the
following is substituted therefor:
"This code shall apply to all forms of subdividing and lot
splitting as defined in Section 10 hereof and shall be
applicable to all land within the City of West Memphis and
certain unincorporated areas of Crittenden County that are
shown on the Planning Area Map, dated April, 1973, and
defined by the boundary description, dated. April 25, 1973."
Section 2. Section 5 - 5.1 of Ordinance No. 716 is amended to add
the following:
"For those subdivisions which are located beyond the Sound
Improvements Line as shown on the Planning Area Map, dated
,,~ April, 1973, and is defined by the boundary description of
the Sound Improvements Line, dated April 2.5, 1973, the
p "` improvement requirements as defined herein are waived. This
provision, however, shall in no way waive the design require-
ments or other provisions of this code."
Section 3. Emergency Clause. It being found and determined by 'the
City Council of the City of West Memphis, Arkansas, that the present subdi-
vision code and regulations heretofore existing are in immediate need of
modification and change in the interest of the orderly growth and expansion
and the health, safety, and welfare of the City of West Memphis, Arkansas,
an emergency is hereby declared to exist and his Ordinance shdll be in full
force and effect from and after 'ts passage and approval as required by law.
