ORDINANCE NO. ~~
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR ROOFING REPAIRS TO
THE WEST MEMPHIS MUNICIPAL COURT, ESTABLISHING AN EMERGENCY AND
FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where such
procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for the City's use
where competitive bidding is deemed not feasible or practical; and
WHEREAS, the West Memphis Municipal Court is in need of
roofing repair work due to rapid deterioration of the roof in
certain departments, and competitive bidding under such
circumstances would not be feasible or practical;
WHEREAS, on September 2, 1999, in response to competitive
bidding, Delta Roofing & Sheet Metal Corp., submitted the only bid
in the amount of $15,325.00 for repairing the roof at the West
Memphis Municipal Court, and Delta has stated they would honor this
same bid;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item
to be used by the City, described as follows:
Roofing repair work at the West Memphis Municipal Court by
Delta Roofing & Sheet Metal Corp., in the amount of
$15,325.00.
2. EMERGENCY CLAUSE. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that there
is an urgent need by the West Memphis Municipal Court to have
roofing repair work done immediately due to rapid deterioration in

certain departments, an emergency is hereby declared to exist, and
this Ordinance being necessary for the preservation of the public
peace, health, safety and welfare of the citizens of West Memphis,
Arkansas, shall be in full force and effect from and after the date
of its passage and approval.
