AN ORDINANCE TO REGULATE YARD SALES AND GARAGE SALES WITHIN THE
CORPORATE LIMITS OF WEST MEMPHIS, ARKANSAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. .Purpose. The purpose of this Ordinance is to regulate yard and garage sales
within the corporate limits of the City of West Memphis, Arkansas.
SECTION 2'. Procedure. All yard or garage sales shall be conducted in a residential zone.
No yard or garage sale shall be conducted in any commercial or industrial zone within the City
of West Memphis, Arkansas.
SECTION 3.: Permits or License Only one (1) permit or license shall be issued to one (1)
household resident or occupant, no more often than semi-annually. The issued permit may be
held for no more than three(3) consecutive days; and, said household resident or.occupant
shall be residents.of the City of West Memphis, Arkansas. The permit or license shall not be
transferrable.
SECTION 4. Fee The fee to conduct yard or garage sales shall be$15.00 for each sale
conducted, and-shall show the address.of the applicant.
SECTION 5. Si&ns No yard or garage sale signs shall be posted on telephone poles,
electric:poles, or placed in any yards, other than the residence with the permit.
SECTION 6. Cancellations. If sale is cancelled due to rain,the sale may be rescheduled,
at no additional cost, provided the City Clerk's Office is notified within three (3) working days of
the rain out.
SECTION 7. Exemptions. Only one (1) permit or license shall be issued to one (1)
household;.resident; church, charitable organization, or Fraternal Organization semi-annually,
and shall not be transferrable. Any person, corporation, church organization, charitable
organization, or Fraternal Organization, which are organized under 501(C) Internal Revenue
Code, shall be exempt from the fifteen-dollar ($15.00)fee.
SECTION 8. Penalty for violations. Any person conducting any sale covered by the
provisions,ofthis ordinance without complying with the provisions hereof and obtaining a
proper permit or license or who shall violate any of the terms and regulations hereof shall,
upon conviction, be fined any sum not less than $50.00 nor more than $200.00, for each
violation and each day on which any such violation shall be considered a separate violation
hereunder.
SECTION 9. All Ordinances or Parts of Ordinances in conflict herein are hereby repealed.
