AN ORDINANCE TO REZONE A TRACT CONTAINING 9. 68ACRES
IN THE W i OF SECTION 16, TOWNSHIP 6 NORTH, RANGE 9
EAST TO RM-1, MULTIPLE FAMILY RESIDENCE DISTRICT,
DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES
WHEREAS, a petition has been filed with the Planning Commission of
West Memphis, Arkansas, for rezoning lands as provided by Ordinance No.
411 of the City of West Memphis, Arkansas; and
WHEREAS, notice was duly published that hearing would be held by
the Planning Commission on the 25th day of September, 1968, at 5:00 p. m.
calling upon interested persons to appear at such hearing and make known
their objections, if any, in connection with said petition for rezoning of the
property hereinafter described; and
WHEREAS, at said meeting on September 25, 1968, no persons appeared
to offer a protest against the rezoning of said property as requested and the
Planning Commission recommended to the City Council that said petition be
granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property located in West
Memphis, Crittenden County, Arkansas, to wit:
That part of the Wz of Section 16, Township 6 North, Range 9
East, described as follows: Beginning at the point of inter-
section of the east line of Walker Avenue and the north line of
the St. Francis Levee right of way, said. point being 25 feet
east of the west line of Section 16, Township 6 North, Range
9 East, Crittenden County, Arkansas; thence north along said
east line of Walker Avenue 540. 0 feet; thence east at a 90
degree angle to said east line of Walker Avenue a distance of
1000. 0 feet; thence south on a line parallel to the east line of
Walker Avenue a distance of 296. 53 feet to a point on the north
line of the St. Francis Levee right of way; thence southwesterly
along said north right of way line 1029. 43 feet to the point of
beginning; containing 9. 68 acres, more or less,
be and the same is hereby rezoned as Rm-1, Multiple Family Residence
District.

SECTION II: That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.

SECTION III: That it is found and declared by the City Council of the
city of West Memphis, Arkansas, that the property above described is in
the process of development and such rezoning is necessary for such develop-
ment; that this ordinance is necessary for the growth and expansion of the
City of West Memphis; and that the passage of this ordinance is in the interest'of
the public health, peace, safety and welfare of the City of West Memphis and
the inhabitants thereof. Therefore, an emergency is hereby declared to exist
and this ordinance shall take effect and be in force immediately on its passage
and approval.
