ORDINANCE NO . ~ ~ ~O -
AN ORDINANCE TO VACATE PORTIONS OF 6TH STREET AND '7TH
STREET IN THE CITY OF WEST MEMPHIS, CRITTENDEN, COUNTY, ARKANSAS,
ACCORDING TO PLAT OF HULBERT HEIGHT SUBDIVISION PREPARED BY C. G
RICHARDSON, C. E., OF RECORD IN PLAT BOOK N0."1" AT PAGE 40 IN
THE OFFICE OF THE CIRCUIT CLERK AND.EX-OFFICIO RECORDER OF
CRITTENDEN COUNTY, ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHE
PURPOSES.
WHEREAS, Emma B. Denson has filed a petition with the
City Council of the City of West Memphis, Arkansas, requesting
that certain property located in Hulbert Heights Subdivision to
the City of West Memphis, Arkansas, as shown in plat prepared by
C. G. Richardson, C. E., said plat being of record in Plat Book
"1" at Page 40 in the off ice of the Circuit Clerkaand Ex-Officio
Recorder of Crittenden County, Arkansas, said property being
designated on said plat as a portion of 6th Street bounded on
the east by the west boundary line of Cox Avenue and bounded on
the west by the east boundary line of Mudge Avenue (now known asl
South Avalon Street) and a portion of '7th Street bounded on the
east by the west boundary line of Cox Avenue and bounded on the
west by the east boundary line of Mudge Avenue (now known as
South Avalon Street), neither 6th Street nor '7th Street now
appearing on the official city map of the City of West Memphis,
Arkansas, and Cox Avenue (now known as Cox Street), not being
shown on said official city map as extending to the areas
designated as 6th Street and nth Street on said plat of Hulbert
Heights Subdivision, be vacated and abandoned, and,
WHEREAS, notice was duly given of a hearing to be
held before the City Council of the City of West Memphis, Arkans
at 3:00 o'clock P. M. on November ~, 1968, for the purpose of
hearing any interested persons in connection with the vacating
of the said portions of 6th Street and '7th Street, and,
WHEREAS, at said meeting petitioner appeared by counse
and requested that the said portions of 6th Street and nth Stree
be vacated and no persons appeared to protest the same, NOW
THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:
SECTION I. That that portion of 6th Street and that
portion of nth Street as shown by said plat of Hulbert Heights
Subdivision to the City of West Memphis, Arkansas, according to
plat prepared by C. G. Richardson, C. E., said plat being of
record in Plat Book "1" at Page 40 in the office of the Circuit
Clerk and Ex-Officio Recorder of Crittenden County, Arkansas, and
bounded on the east by the west boundary line of Cox Avenue and
bounded on the west by the east boundary line of Mudge Avenue
as shown on said plat of Hulbert Heights Subdivision be, and
the same hereby are, vacated and abandoned.
SECTION II. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION III. Emergency Clause: It is found and decla~ed
by the City Council of the City of West Memphis, Crittenden'
County, Arkansas, that this ordinance is necessary for the growt:
and expansion of the City of West Memphis and the property in

question is in the process of development and such g is
necessary for such development. Therefore, an emergency is
hereby declared to exist and this ordinance shall be in full for
and effect from and after its passage, approval and publication
as required by law.
SECTION IV. A copy of this ordinance when duly
certified by the City Clerk shall be subject to being filed
and recorded in the office of the Circuit Clerk and Ex-Officio
Recorder within and fob Crittenden County, Arkansas.
