.AN ORDINANCE TO AMEND CHAPTER 6.26 OF THE WEST MEMPHIS
MUNICIPAL CODE TO ADD A PENALTY PROVISIONS SECTION
RE1;�ARDING WEEDS, GARBAGE AND STAGNANT WATER,AND FOR
OTIIIER PURPOSES.
WIIIEREAS,the West Memphis Police Department and the Public Works Committee
have recorrmended that Chapter 6.26 of the West Memphis Municipal Code regarding Weeds,
Garbage and Stagnant Water be revised to add a penalty provisions section; and
WFIEREAS,the City Council finds that the recommendations of the West Memphis
Police Dep:.rtment and the Public Works Committee are appropriate and should be enacted;
NOW,THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS,THAT:
SECTION 1: Chapter 6.26 of the West Memphis Municipal Code is hereby amended to
add Section 6.26.050, titled"Failure to Eliminate-Penalties" and shall read as follows:
6.26.050 FAILURE TO ELIMINATE - PENALTIES.
A. The failure of any property owner to cut weeds, grass, remove garbage,rubbish
and other unsanitary and unsightly articles and things from their property, and to
eliminate, fill up or remove stagnant pools of water or other unsanitary things,
places or conditions, shall be deemed guilty of a misdemeanor, and upon
conviction,the owners thereof shall be fined no more than one hundred dollars
($100.00) for the first offense. Each day such violation is permitted to continue
shall be considered a separate offense and shall punishable as such.
B. The penalty for subsequent offenses shall be as follows:
1. Two hundred and fifty dollars ($250.00) for the second offense that occurs
within twelve (12)months of the prior offense.
2. Three hundred and fifty dollars ($350.00) for the third offense that occurs
within twelve (12)months of the prior offense.
3. One thousand dollars($1,000.00) for the fourth and any subsequent offense of
the same violation that occurs within twelve (12)months of prior offenses.
SEC TION 2. All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of any such conflict.
