AN�11RDINANCE TO AMEND SECTION 8.04.183 OF THE WEST MEMPHIS
MUM[CIPAL CODE REGARDING FAILURE TO REMOVE DEBRIS,AND FOR
OT11119R.PURPOSES.
WHI?,REAS,the West Memphis Police Department and the Public Works Committee have
recommende,i that Section 8.04.183 of the West Memphis Municipal Code regarding Failure to
Remove Det:is be revised; and
WMi.iREAS,the City Council finds that the recommendations of the West Memphis Police
I,
Department f and the Public Works Committee are appropriate and should be enacted;

NOVh!, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST JAEMPHIS,ARKANSAS, THAT:
SEC"FION E Section 8.04.183 of the West Memphis Municipal Code is hereby amended to'
read as folld%.Vs: ,
A. The failure of any owner, owners and/or occupants of lots or lands within the limits
of the city to remove or have removed concrete, brick or other masonry items,
i roofing material or any construction/remodeling/demolition-type materials, shall be
deemed guilty of a misdemeanor, and upon conviction,the owners thereof shall be
fined no more than one hundred dollars ($100.00) for the first offense. Each day
i I such violation is permitted to continue shall be considered a separate offense and
shall be punishable as such.

I'.!'. The penalty for subsequent offenses shall be as follows:
1. Two hundred and fifty dollars ($250.00).for the second offense that occurs within
twelve(12) months of the prior offense.

2. Three hundred and fifty dollars ($350.00) for the third offense that occurs within
twelve(12) months of prior offenses.

3. One thousand dollars ($1,000.00) for the fourth and any subsequent offenses of
the same violation that occurs within twelve (12)months of prior offenses.

SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
