AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS OF STORM
WATER DRAINAGE PIPES LOCATED IN RICHLAND 5T"ADDITION, PHASE II
TO THE CITY OF WEST MEMPHIS,ARKANSAS,DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WF[EREAS, there are many items necessary for the City's use where competitive bidding is
deemed not feasible or practical; and
WI[EREAS, the City of West Memphis has an urgent need to repair storm water drainage
piping in the location of Richland 5`h Addition, Phase H; and
WHEREAS, Lining & Coating Solutions, LLC, has agreed to perform this work for the
amount of$83,592.00, and competitive bidding under such circumstances would not be feasible or
practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS,ARKANSAS:
1. That competitive bidding be waived for the repair of storm water drainage piping in
Richland 5`h Addition, Phase II Subdivision.
2. That the Agreement from Lining&Coating Solutions,LLC,to perform this work for the
amount of $83,592.00 be approved.
3. EMERGENCY CLAUSE. It having been found and determined by the City Council
of the City of West Memphis,Arkansas,that there is an urgent need for the repair of the storm water
drainage piping due to the current piping collapsing and causing sink holes which could damage
property of residents in the affected area, an emergency is hereby declared to exist, and this
Ordinance being necessary for the preservation of the public peace,health,safety and welfare of the
Citizens of West Memphis, Arkansas, shall be in full force and effect from and after the date of its
passage and :i.pproval.
