AN ORDINANCE VACATING THE ALLEY RUNNING THROUGH
BLOCK 11 AS SHOWN ON PLAT OF WHEELER SUBDIVISION OF
RECORD IN PLAT BOOK 2 AT PAGES 113 AND 114 IN THE OFFICE
OF THE RECORDER OF CRITTENDEN COUNTY, ARKANSAS
ABUTTED BY LOTS 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13,
14, 15, 16 AND 17 IN BLOCK I1 OF WHEELER SUBDIVISION AS
SHOWN ON SAID PLAT
WHEREAS, a petition was duly filed with the City Council of the City of
West Memphis, Arkansas, on July 2, 1970, asking the City Council to vacate
and abandon the alley running through Block 11 as shown on plat of Wheeler
Subdivision of record in Plat Book 2 at Pages 113 and 114 in the office of the
Recorder of Crittenden County, Arkansas, abutted by Lots 1, 2, 3, 4, 5, 6, 7,
8, 9, 10, 11, 12, 13, 14, 15, 16 and 17 in Block 11 of Wheeler Subdivision as
shown on said plat.
WHEREAS, after due notice as required by law, the Council has, at the
time and place mentioned in the notice, heard all persons desiring to be heard
on the question and has ascertained that the alley hereinbefore described has
heretofore been dedicated to the public's use as an alley herein described; has
not been actually used by the public general7,~for a period for at least five years
subsequent to the filing of the plat; that the petitioner is the sole owner of the
property abutting upon the alley to be vacated and has consented to such abandon-
ment; and that public interest and welfare will not be adversely affected by the
abandonment of such alley.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
Section I. The City of West Memphis hereby releases, vacates and
abandons all its right, together with the rights of the public generally, in and
to that portion of the alley designated as follows:

The alley running through Block 11 as shown on plat of Wheeler
Subdivision of record in Plat Book 2 at Pages 113 and 114 in the
office of the Recorder of Crittenden County, Arkansas, abutted
by Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16
and 17 in Block 11 of Wheeler Subdivision as shown on said plat.
Section II. A copy of the ordinance duly certified by the City Clerk shall
be filed in the office of the Recorder of Crittenden County, Arkansas, at Marion
and recorded in the deed records of said county at Marion.
Section III. This ordinance shall take effect and be in force from and
after its passage.
