AN ORDINANCE VACATING THAT PART OF COLE AVENUE EXTENDING
FROM THE EAST LINE OF SOUTH AVALON STREET (MUDGE AVE.) TO THE
WEST LINE OF LANCASTER AVENUE AS SHOWN ON PLAT OF SHOWER'S

~r. SUBDIVISION DATED MAY 10, 1923, IN THE CITY OF WEST MEMPHIS, ARKANSAS.
WHEREAS a petition was duly filed with the City Council of the City of West
Memphis, Arkansas on August _/~~, 1970, asking the City Council to vacate
and abandon that portion of Cole Avenue extending from the West line of South
Avalon Street (Mudge Ave.) to the East line of Lancaster Avenue as shown on Plat
of Shower's Subdivision, West Memphis, Arkansas.
WHEREAS, after due notice as required by law, the Council has, at the time and
place mentioned in the notice, heard all persons on the question and has ascertained
that the portions of the street herein above described has been dedicated to the
public use as a street; that same has not actually been used by the public generally
for at least five (5) years subsequent to the filing of said plat; that all the owners
of the property abutting upon the portions of the street to be vacated have joined
in said petition to vacate; that public interest and welfare will not be adversely
affected by said abandonment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF WEST MEMPHIS,
ARKANSAS:
Section I.
The City of West Memphis hereby releases, vacates and abandons all
of its rights, together with the ri ghts of the public, generally, in the
following street:

Avalon Street (Mudge Ave.) to the West line of Lancaster Avenue
as shovy~on plat of Shower's Subdivision, West Memphis, Arkansas. "

Section II.
A copy of the ordinance duly certified by the City Clerk shall be filed
in the office of the recorder of Crittenden County, Arkansas, at Marion, and
recorded in the deed records of Crittenden County, Arkan sas.
Section III.
This ordinance shall take effect and be in force from after its passage,
