AN ORDINANCE TO RE-ZONE A.ND RE-DESIGNATE CERTAIN PROPERTY
IN SECTIONS ONE AND TWO, TOWNSHIP SIX NORTH, RANGE EIGHT EAST
WHEREAS, a petition has been filed with the Planning Commission
to re-zone and re-designate certain property, hereafter described, as
hereinafter set out; and
WHEREAS, notice was duly published on August 16, 1963, as provided
by law, of a hearing to be held before the West Memphis City Planning Com-
mission at 5:00 p. m, on September 5, 1963, for the purpose of hearing any
interested parties in connection with the re-zoning and re-designating of
said lands; and
WHEREAS, at said meeting on September 5, 1963, said petition was
considered by the Planning Commission and no persons appeared to protest
the same, the Planning Commission recommended to the City Council that
said petition be granted: NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS:
SECTION I. That the following described property, to wit:
That part of Section 2, Township 6 North, Range 8 East,
more particularly described as follows: Beginning at the
southeast corner of said Section 2, thence west along the
south line of Section 2 to the west line of the southeast
quarter of Section 2, thence north along said west line to
the center line of Ten~Mile Bayou Diversion Ditch, thence
east along the center line of Ten-Mile Bayou Diversion
Ditch to the east line of Section 2, thence south along the
east line of Section 2 to the point of beginning,
be, and the same is hereby re-zoned and re-designated as RS-5 Single Family
Resident District.
That the following described property, to wit:
That part of Section 2, Township 6 North, Range 8 East,
E more particularly described as follows: Commencing at
the intersection of the east line of said Section 2 and the
center of Ten-Mile Bayou Diversion Ditch, thence north
along the east line of Section 2 to the north right-of-way
line of Interstate Highway 40, thence southwesterly along
said north right-of-way line to the west line of the south-
east quarter of section 2, thence south along the west line
of the southeast quarter of Section 2 to the center of Ten-
Mile Bayou Diversion Ditch, thence east along the center
line of Ten-Mile Bayou Diversion Ditch to the point of be-
ginning,
be, and the same is hereby re-zoned and re-designated as C-5 General
Commercial District.
That the following described property, to wit:
That part of the NZ SE4 of Section 1, Township 6 North, Range
8 East, described as follows: Commencing at the northeast
E corner of Lot 13 in Block 2 of Avondale Gardens Subdivision in
t the city of West Memphis, Arkansas, as shown by plat of record
~,,, in Plat Book 2 at page 38, run thence north along the east line of
said Lot 13 extended a distance of 50 feet to the point of beginning,
said point of beginning being in the center line of Ten-Mile Bayou
Diversion Ditch; thence continuing north along said east line of
Lot 13 continued a distance of 400 feet; thence west parallel with
the center line of Ten-Mile Bayou Diversion Ditch a distance of
650 feet; thence south parallel with the east line of Lot 13 ex-
tended adistance of 400 feet to the center line of Ten-Mile Bayou
Diversion Ditch; thence east along the center line of Ten-Mile
Bayou Diversion Ditch a distance of 650 feet to the point of be-
ginning,
be, and the same is hereby re-zoned and re-designated as RM-3 Multi-Family
Resident District.
SECTION II . EMERGENCY CLAUSE: It is hereby ascertained and
declared to be a fact that the property above described is in the process of
development; that the passage of this Ordinance is in the interest of the
public peace, health, safety and welfare of the citizens of West Memphis;
therefore, an emergency is hereby declared to exist, and this ordinance
shall be in full force and effect from and after its passage and approval.
